0f the Corporation of the Township of Picketing to assess and
levy for an occupancy tax.
WHEal, AS the 1941 Amendment to the Assessment Act provides under
Section 57a:
"By-laws may be psssed by the councils of municipalities for requiring
every person who, after the rate for the current year on real
property has been levied, commences to occ~py premises, which after
such rate has been levied cease to be exempt from taxation or a
building which was erected after the return of the assessment roll,
to pay an occupancy tax upon the com~.encement of such occupancy.
Amount
(a) The amount of the occupancy tax shall be computed by
reference to the amount of the taxes, including those on
business assessment, which such person would have been
required to pay for the current year in respect of such
premises or building if he had been previously assessed
and made liable therefor, end shall be the part of the
amount of such tsxes that is prooortionste to the part of
the current year then remaining.
Collection
(b) The amount of the occupancy tax may be entered on the
collector's roll and collected in the same manner as taxes.

tenant may deduct tax from rent
(c) A tenant may deduct from his rent any occupancy tax
paid by him which as between him and his landlord the latter
ought to pay.
Appeal
(d) A person who is required to pay en occupancy tax shall
have in respect thereto the right od appeal provided in this
Act in the case of assessments."
AND ~',~EREAS it is deemed advisable that new buildings be assessed
for that portion of the year which they ere occupied and not previously
~aving beem assessed.
BE IT THEREFORE ENACTED by the Municipal Council of the Township
of Picketing:
(1) That the Assessor be required to assess new buildings for t
occupancy tax in compliance with Chapter 272, Section 57a of the
Assessment Act.

(2) That the Clerk be required to levy the current rate of taxes
on said properties and same to the current tax roll.
