OF THE MUNICIPAL CORPORATION OF THE TOWNSHIP OF PICKERING
A BY-LAW to close a westerly portion of the original allowance for road
opposite Lot Number 18 between the 3rd and 4th Concessions of the Township
of Picketing.
_WHEREAS the westerly portion of the said original allowance for road opposite
Lot Number 18 between the 3rd and 4th Concessions of the said Township never
has been opened out for public travel on account of a pond hole which exists
upon it, and in lieu of such portion of original highway a narrow road was
opened on Lot 18 in the said 4th Concession and has been used as a public
road for and during the last 70 years and probably for more than 100 years.
AND WHEBEAS in the public interest it is expedient that the said portion of
original allowance for road as hereinafter described should be closed as a
public highway and sold.
AND ~HEBEAS printed notices of this By-Law have been posted up in six of the
most public places in the immediate neighbourhood of the portion of said
original allowance for road to be closed as aforesaid, and such notice has
been published for four successive weeks in the l>lckering News, a newspaper
published in the said Township of Picketing.
THEHEFOHE the Council of the Municipality of the said Township ENACTS AS
FOLLOWS:
1. That from and after the passing of this By-Law and its confirmation by
the Council of the Corporation of the County of Ontario the portion ~ the
said original allowance for road between Concessions three and four opposite
the westerly part of Lot Number 18 in the 4th Concession of said Township
which is described as follows, that is to say: All and Singular that certain
parcel or tract of land and premises situate, lying and being in the Township
of Picketing in the County and Province of Ontario, and being composed of
part of the original allowance for road between Concessions 3 and 4 of the
said Township, being more particularly described as follows:
COMMENCING at the South-west angle of LOt Number 18 in the 4th Concession of
said Township; Thence north 73 degrees 32 minutes East in and along the
southerly limit of said Lot 1065 feet, more or less, to a point in the
intersection of said limit with the southerly limit of a travelled road
running through said LOt Number 18 (being the narrow road hereinbefore
referred tol; Thence Southerly at right angles to the said southerly
limit of Lot 18 a distance of 66 feet to a point in the northerly limit of
Lot 18 in the Third Concession of the same Township; Thence westerly in and
along said northerly limit 1008 feet, more or less, to the North-West angle of
the last mentioned lot; Thence north westerly a distance of 85 feet 5 inches,
more or less, to the place of beginning,
BE AND THE SAME IS hereby stopped up and closed as a public highway and may
thereafter be sold and disposed of and conveyed to any purchaser by the
Corporation of the Township of Picketing, and the purchase money used in
widening and improving the narrow road which has been used for many years in
lieu of the aforesaid portion of original allowance being closed as a public
highway by the enactment of this By-law.
2. This By-law shall take effect forthwith upon the passing thereof and its
confirmation by the Council of the Corporation of the County of Ontario.
