BY-LAW TO LICENSE, REGULATE AND GOVERN TRANSIENT TRADERS IN THE MUNICIPALITY
OF THE TOWNSHIP OF PIC[ERING-
The Municipal Council of the Corporation of the Township of Pickering
ENACTS AS FOLLOWS:
1. Transient Traders and other persons whose names have not been entered
on the assessment roll of this municipality in respect of income or
business assessment for the then current year, and who offers goods,
wares or merchandise for sale by auction, conducted by themselves
or by a licensed auctioneer or otherwise, or who offers them for sale
in any other manner, shall pay a license fee before commencing to
trade in the Township of Pickering.
2- This By-law shall not apply to the sale of the stook of a bankrupt
or an insolvent, within the meaning of any Bankruptcy or Insolvency
Act in force in Ontario, which is being sold or disposed of within
this municipality, providing such bankrupt or insolvent had been
carrying on business in this municipality at the time of his
becoming bankrupt or insolvent, so long as no goods, wares or
merchandise are added to such stock,
3. Nor shall this by-law apply to the sale of a business to a bona
fide purchaser who continues the same.
4. The fee to be paid for a license under this by-law shall be the sun of
$100.00-
5. The sum paid for a license shall be credited to the person paying
it on account of taxes thereafter payable to this municipality by him.
6. Every transient trader who carries on business in said Township of
Pickering without a license shall be guilty of an offence and shall
incur a penalty equal to the license fee which he should have paid
and in addition thereto the sum of not less than $10.00 and not more
than ;200.00, and all such penalties shall be recoverable under The
Summary Convictions Act, and be adddd to the funds of this
municipality.
7. Every transient trader shall cause his license to be prominently and
permanently displayed in his place of business as a transient trader
and in default thereof shall incur a penalty of not less than ;1.00,
nor more than $10.00, and all such penalties shall also be added to
the funds of this municipality.
9. Every applicant for a transient trader's license shall as part of his
application for such license furnish a statement in writing contain-
ing a full description of the goods, wares or merchandise, which he
proposes to sell or offer for sale under such license.
9. By-Law No. 1315 and all other by-laws or parts of by-laws of this
Corporation contrary to or inconsistent with any of the provisions
of this by-law, be and the saw are hereby repealed,
