HomeMy WebLinkAboutBy-law 3694/69 bein~ a by-law to authorize the construction of water- mains in the Spruce Hill area as local improvements unde/ the p~ovisions ~f Sections 11 and 67 of The Local Improve- WHEREAS it is expedient that the construction of watezmains in the Spruce Hill area of the Township of Pickezing shall be undertaken at the cost hereinafter set out as local improvements under the provisions of Section 11 of The Local Imp/ovement Act; ASD WHEREAS the cost of the said works is to be levied by imposing special assessments therefor against lands in a local improvement area hexelnaftez defined, puxsuant to Section 67 of The Local Improvement Act; AND WHEREAS notice of the intention of Council to the imposing of special rates has been published; NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE TOWNSHIP OF PICKERIN3 ENACTS AS FOLLOWS: 1. That watermains be constzucted on the streets a~d between the poir~s thereon set out on Schedule "A" hereto annexed at an est/mated cost of $275,000.00 as local improve- ments undeI the provisions of The Local Improvement Act. 2. The enti~e cost of the said watexmains is to be specially assessed upon the lands abutting dizectly on the work and upon lands not abutting directly upon the work but immediately benefittir~ therefrom. The entire cost, including debenture charges, shall be assessed and levied on the rateable property in the area set out in Schedule "B" annexed hereto, which is hereby defined a local improvement area puzsuant to Section 67(1) of The Local Imp/ovement Act, R.S.O. 1960, as ame~nded, and be paid by an annual rate of~l,0~pez foot on %he lands specially assessed. 3. The Enginee/ of the Corporation is hereby auth= ized to make such plans, pzofiles and specifications and furnish such information as may be necessary for the making of contracts -2 - fox the doing of the work or fox caxxying out %he same by day labour and the work shall be carried on and executed under the superintendence and accoxding to the directions ar~ orders of the said engineer. 4. The entire cost of the sa/d wateImalns is to be paid by the issuing of debentures bearing interest at the /ate of ~ peI centum per annum and be repaid by the special assessments over a term of 20 years. 5. The Tzeasuzez of the Township may~ subject %o the approval of Council~ agree with any bank or person, for temp- orary advances of money to meet the cost of the work pending completion theI eof. 6. Any person whose lo~ is specially assessed may commu~e by a payment in cash ~he special Iate imposed by paying the cost of construction assessed upon such lot without the interest forthwith after the special assessment roll has been certified by the Clerk. but may not commute after the debenture by-law has been passed.
