Being a by-law to further amend
By-law 3036.
WHEREAS the Council of The Corporation of the Township
of Pickering deems it desirable to amend By-law 3692/69, pursuant
to the provisions of The Planning Act, R.S.O. 1960, Section 30,
as amended, fox the purpose of clarifying same and removing any
ambiguities insofar as it relates to the lands shown on Schedule
"A" and described in Schedule "B" thereto
NOW TI-EREFORE THE COUNCIL OF THE CORPORATION OF THE
TOWNSHIP OF PICKEI4NG ENACTS AS FOLLOWS:
1. That section B., text amendment, of By-law 3692/69 is
hereby repealed and the following inserted in lieu thereof:
B. TEXT AMENDMENC
1. That section 12 of By-law 3036 is hereby amended by adding
thereto the following:
12.4 EXCEPT IONS
12.4.1. Part of Lot 20, Concession 1, and Lots 1 and 2, Plan 316.
Notwithstanding the provisions of section 12.1, the lands
described in Schedule "B" annexed hereto and forming part
of this by-law shall be used exclusively for the operation
of a food market with complementary retail stores.
2. This by-law shall not come into force without the approval
of the Ontario Municipal Board but, subject to such approval, shall
take effect from the date of passing thereof.
Read a first, second and third time this I day of Lc" , 1970.
SCHEDULE "B"
ALL AND SINGULAR that certain parcel or tract of land and
premises, situate, lying and being in the Township of Pickering,
in the County of Ontario, and being composed of:
FIRSTLY
The whole of Lots 1 and 2, according to Plan Number 316,
registered in the Registry Office for the Registry Division of the
County of Ontario.
SECONDLY
Part of Lot 20 in the first Concession of the said Township,
which is more particularly described as follows:
PREMISING that the bearing of that part of the north limit
of the Kingston Road extending south-westerly from the intersection
of the said north limit with the east limit of the said Lot 20 is
North 47 degrees 46 minutes 30 seconds East and relating all bearings
used herein thereto;
COMMENCING at a point in the said east limit of Lot 20
distant 175.49 feet measured northerly therealong from the said point
of intersection;
THENCE South 47 degrees 46 minutes 30 seconds West to
a point in line with a fence, running northerly a distance of 131.45
feet;
THENCE North 19 degrees 26 minutes West along said fence
to a point in a fence, running north-easterly a distance of 638.30
feet;
THENCE North 47 degrees 39 minutes East along said fence
to a point in the said east limit of Lot 20, a distance of 161.0
feet more or less;
THENCE southerly along said east limit a distance of
650-73 feet to the POINT OF COMMNCEMENT.
