HomeMy WebLinkAboutBy-law 3891/70TOWNSHIP OF PICKERING BY-LAW NUMBER being a by-law to fix the price for and authorize tite sale of part of the road allowance between Lots 14 and 15 in Concession 2 of the Township of Pickering. WHEREAS the 66 foot road allowance between Lots 14 and 15 in Concession 2 of the Township of Pickering was laid out, improved and travelled partly on Lot 14 and partly on the road allowance between Lots 14 and 15 in Concession 2 instead of on the road allowance abutting the westerly and easterly limits respectively of said Lots 14 and 15; AND WHEREAS the Council of the Township of Pickering enacted By-law 407 in 1876, on the petition of all of the owners of land abutting on the said road allowance, establishing the 66 foot road allowance as then travelled and as described in said By-law 407 as a public highway in lieu of the original 66 foot road allowance; AND WHEREAS it is deemed expedient to offer part of the original road allowance that was not established as a road by said By-law 407 to the owners in legal possession thereof who, having enclosed the said land with a lawful fence along with their lands in Lot 15 abutting on the original road allowance, are the persons entitled to purchase the said lands pursuant to the provisions of section 477 of The Municipal Act, R.S.O. 1960. NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE TOWNSHIP OF PICKERING ENACTS AS FOLLOWS: 1. The price at which that part of the original road allowance between Lots 14 and 15 in Concession 2 of the Town- ship of Pickering described in Schedule "A" hereto is to be sold is $20638.00. - 2 - 2. The Reeve and Clerk are hereby empowered to accept an offer to purchase the said lands described in Schedule "A" hereto from Jerry and Zdenka Hasek, the owners in legal possess- ion of the said lands and the lands in Lot 15 abutting the lands herein, and to execute all documents required to complete the sale of the said lands. READ a first, second and third time and passed in open Council this /- `- day of C'i x44;c,?, , 1970. SCHEDULE "A" ALL AND SINGULAR that certain parcel or tract of land and premises situate, lying and being in the Township of Pickering and County of Ontario, and being composed of part of the road allowance between Lots 14 and 15 in the second Concession, which parcel may be more particularly described as follows: PREMISING that the bearing of the east limit of the said Lot 15 in Concession 2 is North 17 degrees 47 minutes 30 seconds West and relating all bearings used herein thereto, then, COMMENCING at a point in the said road allowance between Lots 14 and 15 in Concession 2 which may be located as follows: BEGINNING at the south-east angle of the said Lot 15, Concession 2; THENCE North 17 degrees 25 minutes 30 seconds West along the west limit of Church Street opened by By-law 407 for the Township of Pickering, a distance of 2,548.92 feet; THENCE South 74 degrees 56 minutes 10 seconds West to a point of intersection with a line drawn parallel to the said west limit of Church Street North, as established by By-law 407 and distant westerly therefrom 10.0 feet measured at right angles thereto, a distance of 10.01 feet, said point of intersection being the POINT OF COMMF.NCSMENI; THENCE from the point of commencement North 17 degrees 25 minutes 30 seconds West along the said parallel line to a point in line with a fence running westerly, a distance of 1,941.69 feet; THENCE South 75 degrees 00 minutes 20 seconds West along the said fence to its intersection with the said east limit of Lot 15, Concession 2, a distance of 18.96 feet; - 2 - THENCE South 17 degrees 47 minutes 30 seconds East along the said east limit of Lot 15 to a point in line with a fence running westerly from the said point of commencement, a distance of 1,942.28 feet; THENCE North 74 degrees 56 minutes 10 seconds East along the last mentioned fence a distance of 6.52 feet more or less to the POINT OF COMMENCEMENT.
