WHEREAS by The Criminal Law Amendment Act 1968-69, Section 179A of The Criminal Code was enacted authorizing the Lieutenant- Governor-in-Council of a Province to authorize the issue of a licence to conduct and manage a lottery scheme; AND WHEREAS Regulations were approved by the Lieutenant- Governor-in-Council by Order-in-Council 274/70 giving authority to municipal corporations to license lotteries to be operated and managed in the manner prescribed by the Regulations. NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE TOWNSHIP OF PICKERING ENACTS AS FOLLOWS; 1. The Council of the Corporation of the Township of Pickering deems it expedient that a Lottery Licensing Officer be appointed to issue a license authorizing charitable or religious organizations to conduct and manage a bingo lottery, a raffle lottery or a lottery scheme held at a bazaar provided such lottery is conducted in accordance with the Regulations approved by Order-in-Council 274/70 and any subsequent Regulations. 2. The Lottery Licensing Officer is hereby authorized from time to time to issue a licence in the approved form to any of the charitable or regigious organizations deemed to be charitable organizations within the meaning of the Order-in-Council provided the terms and conditions and procedures provided by the Order- in-Council are complied with. 3. No person or company or organization shall conduct a lottery without a licence or when the licence has been suspended. 4. In the event that a licensee fails to comply with any of the provisions of the Criminal Code or of any Regulations or with this By-law or any amendment thereto the Lottery Licensing Officer may notify the licensee by registered mail of the suspension of the licence or may serve notice of suspension upon the licensee and thereupon the licensee shall cease the lottery. -z- 5, A licence other than for a bingo lottery shall be issued for a single occasion only. 6. A licence for a bingo lottery may be issued for a single occasion or for a number of occasions during a period not exceeding one year. 7. No licence shall be issued to an applicant that is in default in compliance on any previous occasion with the terms of this By-law or the Rules and Regulations provided by Order-in-Council unless approved by the Township Council. 8. No licence shall be issued until the licence fee is paid. 91 The licence fee shall be as provided in Schedule "A" of this By-law. READ A FIRST, SECOND AND THIRD TIME AND PASSED this sr 1970. Reeve day of -- -- -- -'---- Clerk SCMDULE "411 LICENCE FEES - BINGO LOTTERIES FEE SCHEDULE: (A) For a single bingo lottery licence: where the total value of all prizes to be awarded within the operation of each bingo lottery does not exceed $500.00 - a fee of $2.00 where the total value of all prizes to be awarded within the operation of each bingo lottery exceeds $500.00 and not more than $3,500.00 - a fee of 2% of the total value of prizes to be awarded. (B) For a series of Bingo Lotteries covered by one licence: an initial fee of 1% of the total value of all prizes to be awarded within the operation of each bingo lottery, provided, however, that the minimum licence fee shall be $5.00. - an additional fee of $2.00 for each subsequent bingo during which the licence is to apply, provided that no licence shall be granted beyond a current calendar year. LICENCE FEES BAZAAR LOTTERY SCHEMES For each Bazaar Lottery Scheme - $2.00 LICENCE FEES - RAFFLE LOTTERIES (1) - where the total value of all prizes to be awarded does not exceed $500.00 - a fee of $2.00. (2) - where the total value of all prizes to be awarded exceeds $500.00 and not more than $3,500.00 - a fee of 2% of the total value of all prizes to be awarded.
