BY-LAW NO._J!?74/_13
Being a restricted area by-law to
implement the Official Plan of the
Township of Pickering in Part of
Lot 19, Concession 1, Township of
Pickering.
NOW THEREFORE the Council of the Corporation of the Township
of Pickering enacts as follows:
SECTION 1: SCHEDULES
Schedules "A", "B" and "C" hereto with notations
and references shown thereon are hereby declared to be part
of this by-law and are described as follows:
Schedule "A" Highway 2 - Brock Zoning Map
Schedule "B" Standards & Provisions
Schedule "C" Building & Structure Set-back
Provisions
SECTION 2: AREA RESTRICTED
The provisions of this by-law shall apply to all
lands enclosed by heavy black line on Schedule "A" hereto.
SECTION 3: GENERAL PROHIBITION
No building or land shall hereafter be used or
occupied, no building or part thereof, shall be erected,
moved or structurally altered except in conformity with
the provisions of this by-law.
SECTION 4: DEFINITIONS
"Building Height" shall mean the vertical distance measured
in feet or storeys from the established grade to the highest
point of the roof surface.
"Coverage" shall mean the percentage of lot area covered
yb?]a 3ulildings.
"Dwelling" shall mean one or more rooms, occupied or capable
of being occupied as an independent and separate housekeeping
unit containing a separate kitchen and sanitary facilities.
"Gross Floor Area" shall mean the total floor area of all
floors inclu ing basements.
"Landscaped Open Space" shall mean that percentage of the lot
area not covered by buildings driveways and parking spaces.
"Parking Structure" shall mean a building for thetemporary
storage o one or more vehicles accessory or incidental
to the use provided for in a particular zone.

"Residential-A artment" shall mean a building containing
Five 5 or more dwelling units each having access from
an internal corridor system.
?fstt?o?r X" shall mean that portion of a building (including
abasement which is less than 50% below ground level)
between the surface of any floor and the surface of the
floor, roof deck or ridge above it. This shall not include
a cellar or attic.
SECTION 5: PROVISIONS
The performance standards and provisions as set
out on Schedule "B" hereto shall apply to the Area
restricted by this By-law.
SECTION 6: BY-LAW 3036
By-law 3036 as amended is hereby further amended
only to the extent necessary to give effect to the
provisions of this By-law as it applies to the area set
out in Schedule "A" hereto. Definitions and subject matters
not specifically dealt with in this By-law shall be governed
by the provisions of By-law 3036 as amended.
SECTION 7: ENFORCEMENT
Any person convicted of a breach of any provision
of this By-law shall forfeit and pay, in the discretion of
the convicting Magistrate, a penalty not exceeding (exclusive
of costs) the sum of Three Hundred Dollars ($300.00) for
each offence, recoverable under The Summary Convictions Act.
SECTION 8: EFFECTIVE DATE
This By-law shall come into force and take effect
upon being passed by Council subject to the approval of
the Ontario Municipal Board.
