BY-LAW NUMBER
Being a by-law to sell a stopped-up
portion of the road allowance known
as St. Martin's Drive, formerly
Fairport Street, of Registered Plan
No. 239-
WHEREAS a Municipality is empowered by Section 443 of The
Municipal Act, R.S.O. 1970, C. 284 to stop up highways and to sell
the soil and freehold of such stopped-up highway;
AND WHEREAS by virtue of Section 461 of the said Municipal
Act, a municipality may fix by by-law the price at which such
stopped-up highway may be sold to abutting owners and the period
within which the same may be sold;
AND WHEREAS said stopped-up portion of said road allowance
was stopped up by By-law #3802/709 passed on May 4, 1970;
AND WHEREAS said By-law Number 3802/70 was confirmed by
By-law Number 2780 of the Council of the County of Ontario passed
at the regular meeting of the County Council on the 16th day of
June, 1970.
NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE
TOWNSHIP OF PICKERING ENACTS AS FOLLOWS:
1. That the soil and freehold of the stopped-up portion of
the road allowance known as St. Martin's Drive (formerly
Fairport Street) of Registered Plan No. 239, as more
particularly described in Schedule "A" attached hereto
be sold to the abutting owners for the total consideration
of $33,750.00, said parcel containing by admeasurement an
area of 0.676 acres.
29 That the said abutting owners be allowed the right to
complete the purchase of the said stopped-up portion
of the road allowance for the said price within am-Fat4 n

3. That if the said abutting owners do not exercise the
said purchase within the time limited herein or within the
time limited in any subsequent by-law, the Township may
sell said lands to any other person at the same or a
greater price.

That the Reeve and Clerk be,and the same are hereby,
authorized to execute any documents necessary to give
effect to this by-law.
5. That by-laws 4040/71 and 4073/71 are hereby repealed.

SCHEDULE "A" to By-law #4131/72
ALL AND SINGULAR that certain parcel or tract of land and
premises situate, lying and being in the Township of Pickering,
in the County of Ontario and Province of Ontario, being
composed of part of a street formerly known as Fairport
Street, according to a plan registered in the Registry Office
for the Registry Division for the County of Ontario as Number
239, and which said street is now known as St. Martin's Drive
as named by By-law Number 3161, which said parcel of land
containing by admeasurement an area of 0.676 acres be the
same more or less, is more particularly described as follows:
PREMISING that all bearings herein are astronomic and are
referred to the North 17 degrees, 09 minutes, 00 seconds West
of the Westerly limit of Block Y according to a plan filed in
the Land Titles Office at Whitby as Number M-16;
COMMENCING at an iron bar marking the Northeasterly angle of
Block F according to the said Registered Plan No. 239;
THENCE South 17 degrees, 09 minutes, 00 seconds East, along
the Easterly limit of Block F, being also the westerly limit of
St. Martin's Drive, 469.03 feet more or less to an iron bar
marking the Southeasterly angle of the said Block F;
THENCE North 30 degrees, 45 minutes, 10 seconds East, 88.94
feet more or less to an iron bar marking the Southwesterly
angle of Block Y as shown on the said Plan Number M-16;
THENCE North 17 degrees, 09 minutes, 00 seconds West, along
the Westerly limit of Block Y, being also the Easterly limit
of St. Martin's Drive, 422.90 feet more or less to an iron
bar found planted;
THENCE South 61 degrees, 18 minutes, 15 seconds West, 67.36
feet more or less to the point of commencement.
