THE CORPORATION OF THE TOWNSHIP OF PICKERING BEING A BY-LAW TO AMEND RESTRICTED AREA BY-LAW 3036, as amended; WHEREAS the Council of the Corporation of the Township of Pickering deems it desirable to further amend the provisions of By-law 3036. NOW THEREFORE, the Council of the Corporation of the Township of Pickering ENACTS AS FOLLOWS: A. SCHEDULE "A" AMENDMENTS 1. Schedule "A" of By-law Number 3036 be and the same is hereby amended by altering the Storage and Light Manufacturing Zone "M1" and Rural Agricultural Zone "A" in Part of Lot 20 Concession 1 north of Highway #401 owned by the Hydro Electric Power Commission and containing their transmission lines; to read Public and Private Open Space Zone "0,2" as shown as Item 1 on Schedule "A1" attached hereto. 2. Schedule "A" of By-law Number 3036 be and the same is hereby amended by altering the Storage and Light Manufacturing Zone "M1" designation in Part Lot 20 Concession 1 to read Multiple Family Dwelling Second Density Holding zone "(H)RM2" and Multiple Family Dwelling Third Density Holding Zone "(H)RM3" as shown as Items 2a and 2b respectively on Schedule "A21" attached hereto. 3. Schedule "A" of By-law Number 3036 be and the same is hereby amended by altering the Highway Commercial Zone "C3" in Part Lot 21, Concession 1 to read: a) General Commercial Holding Zone "(H)C2" b) Multiple Family Dwelling Fourth Density Holding Zone "(H)RM4" c) Multiple Family Dwelling Second Density Holding Zone "(H)RM2" All as shown as items 3a, 3b, and 3c respectively on Schedule "A3" attached hereto. 4. Schedule "A" of By-law Number 3036 be and the same is hereby amended by altering a) the General Commercial Zone "C2" and the Storage and Light Manufacturing Zone "M1" in part Lot 21 Concession 1 to read Greenbelt Conservation Zone "G" b) the Storage and Light Manufacturing Zone "M1" in part Lot 21 Concession 1 to read Multiple Family Dwelling Second Density Holding Zone "(H)RM2" c) the Storage and Light Manufacturing Zone "M1" in Part Lot 21 Concession 1 to read Multiple Family Dwelling Third Density Holding Zone "(H)RM3" As shown as items 4a, 4b, and 4c on Schedule "A4" attached hereto. continued .... 2 - 2 - 5. Schedule "A" of By-law Number 3036 be and the same is hereby amended by altering the Storage and Light Manufacturing Zone 11M1" in Part Lot 22 Concession 1 to read Multiple Family Dwelling Fourth Density Holding Zone "(H)RM4" as shown as Item 6 on Schedule "A6" attached hereto. 7. Schedule "A" of By-law Number 3036 be and the same is hereby amended by altering the westerly Local Commercial Zone "Cl" in Part Lot 23 Concession 1 to read One Family Detached Dwelling Third Density Holding Zone "(H)R3" as shown as Item 7 on Schedule "A7" attached hereto. 8. Schedule "A" of By-law Number 3036 be and the same is hereby amended by altering the easterly Local Commercial Zone "Cl" in Part Lot 23 Concession 1 to read: a) One Family Detached Dwelling Third Denisty Holding Zone "(H)R3" b) Highway Commercial Zone "C3" As shown as Items 8a and 8b respectively on Schedule "AS" attached hereto. B 9. Schedule "A" of By-law Number 3036 be and the same is hereby amended by altering the Highway Commercial Zone "C3" in Part Lot 23 Concession 1 to read Highway Commercial Holding Zone "(H)C3" as shown as Item 9 on Schedule "A9" attached hereto. 10. Schedule "A" of By-law Number 3036 be and the same is hereby amended by altering part of the One Family Detached Dwelling Third Density Zone "R3" in the west part Lot 23 and east Part Lot 24 Concession 1 south of Highway #2 to read Storage and Light Manufacturing Holding Zone "(H)M1" as shown as Item 10 on Schedule "A10" attached hereto. TEXT AMENDMENTS 1. That sections 10A, 10B and 10C be inserted after Section 10 with corresponding amendments to the table of contents, zone classifications in subsection 4.1; and symbols in subsection 4.2.1 as follows: continued ... 3 SECTION 10A MULTIPLE FAMILY DWELLING SECOND DENSITY ZONE RM 2 The following provisions shall apply in all MULTIPLE FAMILY SECOND DENSITY ZONE RM2: No person shall hereafter use any building, structure or land nor erect any building or structure except in accordance with the following provisions: 10A.1 USES PERMITTED Multiple attached dwellings 10A.2 AREA REQUIREMENTS 10A.2.1 COMBINED LOT FRONTAGE AND FLANKAGE Minimum - 100 feet frontage and/or flankage per acre of lot area with each portion thereof being in the same ratio as 100 feet per acre. 10A.2.2 Yard Requirements Front Yard 25' Side Yard 20' Rear Yard 25' Distance between buildings 25' Minimum distance from Freeway 90' 10A.2.3 Gross Floor Area Minimum each dwelling unit - 1,050 sq.ft. 10A.2.4 Coverage Maximum all buildings - 30% 10A.2.5 Floor Space Index The gross floor area of all main buildings on the lot shall not exceed 50% of the lot area. (i.e. F.S.I. is equal tc, or less than 0.5) 10A.2.6 Landscaping Minimum - 35% of the lot area, and all yards other than driveways and parking spaces shall be landscaped. 10A.2.7 Height Maximum above grade - 30' 10A.2.8 Density Maximum 16 units per net site acre - 4 - SECTION 10B MULTIPLE FAMILY DWELLING Third Density Lone - RM3 The following provisions shall apply in all MULTIPLE FAMILY DWELLING THIRD DENSITY ZONES RM3 No person shall hereafter use any building, structure or land nor erect any building or structure except in accordance with the following provisions: 10B.1 USES PERMITTED Multiple attached dwellings Apartments 10B.2. AREA REQUIREMENTS 108.2.1 Combined Lot Frontage and Flankage Minimum - 100 feet frontage and/or flankage per acre of lot area with each portion thereof being in the same ratio as 100 feet per acre. 10B.2.2 Yard Requirements Front Yard 30' Side Yard 25' Rear Yard 25' Minimum distance be- tween buildings 25' between multiple attached dwellings. The minimum distance between walls of adjacent buildings, other than two adjacent multiple attached buildings, shall be equal to the average of the heights of the two buildings concerned. Minimum distance from Freeway - 90' for buildings of 4 stories or less) 150° (for buildings over 4 stories in height) 10B.2.3 Gross Floor Area Multiple Attached-Minimum each dwelling unit - 1,050 sq. ft. 10B.2.4 Coverage Maximum all building - 30% 10B.2.5 Floor Space Index The Gross Fluor Area of all main buildings on the lot shall not exceed 120% of the lot area. (i.e. F.S.I. is equal to or less than 1.2) continued ... 5 -5- Section 10B continued 10B.2.6 Landscaping Minimum - 50% of the lot area and all yards other than driveways and parking spaces shall be landscaped. 10B.2.7 Height Maximum above grade - 60' 10B.2.8 Density Maximum - 40 units per net site acre SECTION 10C MULTIPLE FAMILY DWELLING FOURTH DENSITY ZONE RM4 The following provisions shall apply in all MULTIPLE FAMILY FOURTH DENSITY ZONES RM4; No person shall hereafter use any building, structure or land nor erect any building or structure, except in accordance with the following provisions: 10C.1 USES PERMITTED Apartments 10C.2.1 Combined Lot Frontage and Flankage Minimum - 100 feet frontage and/or flankage per acre of lot area with each portion thereof being in the same ratio as 100 feet per acre. 10C.2.2 Yard Requirements Front Yard 50' Side Yard 40' Rear Yard 40' Minimum distance between buildings - The minimum distance between walls of adjacent buildings, shall be equal to the average of the heights of the two buildings concerned. Minimum distance from freeway - 200' Minimum distance from all other roads 10C.2.3 Coverage Maximum all buildings - 112 height of building or 50° whichever is greater = 20% continued ... 6 - 6 - Section 10C continued 10C.2.4 Floor Space Index The Gross Floor Area of all main buildings on the lot shall not exceed 150% of the lot area (i.e. the F.S.I. will be equal to or less than 1.5) 10C.2.5 Landscaping Minimum - 65% of the lot area and all required yards other than driveways and parking areas shall be landscaped. 10C.2.6 Height Notwithstanding the requirements of section 5.9, the maximum above grade height, exclusive of penthouse shall not exceed 160 feet. IOC. 2.7 Density Maximum 60 units/net ette acre C. That By-law 3036 be and the same is hersby amended only to the extent necessary to give effect to the provisions of this By-law. D. No part of this By-law shall come into force without the approval of the Ontario Municipal Board, but subject to such approval, the By-law shall take effect from the day of passing thereof.
