S.O. 19 01 Sec:i:J.oi 35', paragraph 1 and Section 5 of Tha Dog Licensing and Live Stock and Poultry Protection Act, authority to enact this by-law; NOW THEREFORE, the Council of the Town of hereby enacts as follows:- 1. (a) "Dog" means a male or female clog, over ts:e age of 12 weeks; (b) "Owner" of a dog includes any person who possesses or harbours a dog and "owns" or "owned" have a corresponding meaning; (c) "Animal Control Officer" includes the person or Association who has entered into a contract with the Corporation of the Town of to control dogs and to r..aintain a cog pol_"nd and any servants or agents of such per.s: n. 2. ?:very ocdner of a dog sn.all, on or ba`ore ina day of Narch in each and every year, or upon h,.coming th:=_ o"dner o L' , doq after the 1st (3!'- March , register such do-, with the Co'?porati.oi? of the Todn o;? ??C4!r';'ti? and procure licen.cc and dog tag for each dog owned by him. 3. Every dog tag shall bear the serial number and the year in which it was issued and a recor' small be kept by the Corporation of the Town showing the name and address of the owner and the serial number of the tag. 5. The owner shall keep the dog tag securely fixed on the dog at all times. 6. Should a dog tag become lost, the Owner shall upon the payment of a $2.00 fee be entitled to the issuance of a replacement licence and a replacement tag. 2 - 7. No owner i i ?. Every licence issued pursuant to this by-law shall expire on the 31st day of December of the year in respect of which it was issued and the licence ?fee to be paid to the Corporation of the Town of at the time of the issuing of the licence shall be as follows:- (a) For each dog -- $10.00 10. Notwithstanding the provisions of the owner of a kennel of purebred in the register of the Canadian K Incorporated, shall pay an annual Twenty-Five Dol,P,ars ($25.00) into of the Town of and such liable to pay any-further licence of such purebred dogs. (c) Any person shall be entitled to take charge of any doq found running at large and deliver the same to theihnimal Control Officer of the Town of 12. Subject to subsection (e ) of this Section, a Peace Officer or Animal Control Officer may (a) Seize and impound any dog found running at large; and (b) Restore possession of the dog to the Owner thereof where:- (1) The Owner claims possession of the dog within five days (exclusive of statutory holidays and Sundays) after the date of seizure, and (2) The Owner pays to the Peace Officer or Animal Control Officer or other duly authorized person a Pound fee of Ten Dollars ($10.00) for a dog seized and impound=:3 plus a maintenance sum of Two Dollars ($2.00) for each day subsequent to the clay of seizure that ? the dog remains impounded. (3) If the Animal Control officer is unable to seize any dog found to he at large contrary to this by-law and the Owner of such a doq is }mown to the Animal n-, n P,V ,_.:.t ($io.00). Nuun Lae i;ay c,Wisr ba EMU to the Animal Control officer or other duly authorized person or t the Corporation of the 'Down of QFWO,;' witi-iin se.v?n days ui noLiiication by the Animal Control Officer of the offence committed under this paragraph. - (4) Rny female dog found to be running at large in heat shall be held at the Pound until no longer in heat, but in any case no longer than 21 days- (5) Where a dog is impounded, the Owner, if known, and whether the dog is claimed from the Pound or not, shall be liable for the Pound and maintenance fees prescribed and shall pay all fees on demand by the Animal Control Officer. (c) Where, at the end of the said five days, possession of the dog has not been restored to the Owner under subsection 1, the Animal Control Officer or other duly authorized person may sell or dispose of the dog. (d) 1,7here the Owner of a dog has not claimed the dog within five days after its seizure under subsection 1 abOV8 acid the dog has not been sold, the Animal Control Officer may kill the dog in a humane manner or otherwise dispose of the dog as he sees fit and no damages or compensation shall be recovered oa account of its killing or other disposition- (e) Where a dog- seized under subsection 1 of this section is injured or should be destroyed without delay for humane reasons or for reasons of safety to persons or animals, the Peace Officer or Animal Control Officer may kill the dog in a humane manner as soon after seizure as he sees fit without permitting any person to reclaim the dog or without offering it for sale and no damages or compensation shall be recovered on account of its }tilling except that where the Owner of the animal is known, he.may be permitted to make arrangements for the animal to be transferred at his expense to a veterinary hospital. (f) No dog shall be -returned to the Owner unless it has been licenced in accordance with the provisions of this by-law and any Owner of a dog without a licence or a dog tag and any purchaser of a dog without a licence or a dog tag shall obtain a licence and a dog tag for the current year before delivery is made. (a) Notwithstanding any other provisions o. this by-law, every person who contravenes Section 11 of this by-law is guilty of an oEfenc and on summary conviction is liable to a fine of not more than Fifty Dollars ($`-10.00) exclusive of costs, and every such Fine is recoverable under The Su-unary Convictions Act. (b) Notwithstanding the provisions of subsection (1) of Section 13, any person may, upon presentation of the sununons issued pursuant to this by-law alleging commission of an offence under this by-law pay out of court within five days from the date of issue of the said su runs (exclusive of Saturday, Sunday and holidays) the sn..-n of Ten Dollars ($10.00), if the summons provides that such sum may be so paid out of court. 14.
