HomeMy WebLinkAboutBy-law 322/75THE CORPORATION OF THE TOWN OF PICKERING BY-LAW NUMBER 3.2-al-7; Being a By-law to provide for the clearing away and removal of snow and ice at the expense of the the municipality. WHEREAS the Corporation of the Town of Pickering has pursuant to the Municipal Act, R.S.O. 1970, chapter 284, section 354 (1), paragraph 57a, authority to enact this By-law; NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE TOWN OF PICKERING ENACTS AS FOLLOWS: INTERPRETATION 1. In this By-law, - eND MiN??AN ?N? (a) "building" means the private residence of ',an eligible person, and does not includen?boarding house, rooming house, apartment building, inn, hotel, motel or residential institution of any kind; (b) "eligible class of persons" means a class of persons each of whom is resident in the Town in a building in which no other person capable of clearing away and removing ice and snow resides, and (i) who is sixty-five years of age or older or (ii) who is in the opinion of the Administrator or his designate, physically unable to clear away and remove snow and ice, and who makes application for and is approved for services provided herein; (c) "eligible person" means a member of an eligible class of persons; (d) "highway" means a common and public highway, and includes a street and a bridge forming part of a highway.or on, over or across which a highway passes; (e) "sidewalk" means a common and public paved walkway. 2. Subject to sections 3 and 4, the Town of Pickering shall clear away and remove snow and ice, at its expense, from the sidewalks on the highways infront of, alongside or at the rear of buildings owned or occupied by an eligible class of persons, and from those portions of walkways between the highways or the public sidewalks on highways, as the case may be, and the lowest step of the principal place of entrance of such buildings. ...2 - 2 - Application for the services proAded herein shall be made in a form satisfactory to the Administrator, or his designate, and shall include, as the Administrator or his designate may in his sole discretion require, proof of age or a medical certificate of physical inability signed by a duly qualified medical practitioner. Prior to the commencement of any services provided herein, and in consideration of the future provision of those services the eligible person shall enter into an agreement with the Town of Pickering in which the eligible person shall agree to release and indemnify the Town of Pickering, its agents, servants, employees and representatives and to release and indemnify the supplier of the services, from any claim or demand occasioned by or resulting from the malfeasance, nonfeasance or other negligent action or omission of the Town, its agents servants, employees and representatives, or of the supplier of the services, in the provision of the services. The Mayor and Clerk are hereby authorized to execute the Indemnification Agreements required in section 4 hereof, on behalf of the Town of Pickering.
