HomeMy WebLinkAboutBy-law 316/75THE CORPORATION OF THE TOWN OF PICKERING BY-LAW NUMBER 31? -7-,' Being a By-law to amend By-law Number 4394/73 of the former Township of Pickering which provided for the sale of part of Lot 18, Range 3, Broken Front Concession to Orangebrook Developments Limited and to repeal By-law Number 313/75. WHEREAS By-law Number 4394/73 of the former Township of Pickering authorized the sale of certain land to Orangebrook Developments Limited and authorized the Reeve and Clerk to execute on behalf of the Corporation of the former Township of Pickering a Deed conveying the land to Orangebrook Developments Limited, more particularly described as Part 1 on Reference Plan 40R-1065 filed in the Registry Office for the Registry Division of the Region of Durham (hereinafter called the "land"); AND WHEREAS the Treasurer of Ontario and Minister of Economics and Intergovernmental Affairs approved the sale of this property on July 20th 1973, as required under section 122 of The Regional Municipality of Durham Act, R.S.O. 1973, c. 78; AND WHEREAS by a Deed dated the 21st day of June 1973 and registered on the 27th day of July 1973 the former Corporation of the Township of Pickering conveyed the land to Orangebrook Developments Limited, as to an undivided 50% interest and Ballycroy Investments Limited, as to the remaining 50% interest; AND WHEREAS the conveyance to Orangebrook Developments Limited and Ballycroy Investments Limited may not be valid for the reason that the former Township of Pickering only had authority under By-law Number 4394/73 to sell to Orangebrook Developments Limited; AND WHEREAS it is desirable to amend By-law Number 4394/73 to provide the necessary and required authority to sell the land to the grantees described in the Deed; AND WHEREAS the Corporation of the Town of Pickering and the Regional Municipality of Durham are the legal successors to the former Corporation of the Township of Pickering and have the legal power to amend By-law Number 4394/73. NOW THEREFORE BE IT HEREBY ENACTED: 1. That By-law Number 4394/73 of the former Township of Pickering be amended by repealing paragraphs 1 and 2 thereof and substituting the following therefor; 1. That that part of Lot 18, in Range 3, Broken Front Concession, of the Township of Pickering, as described in the Agreement of Purchase and Sale dated May 10th 1973 be sold to Orangebrook Developments Limited as to an undivided 50% interest and Ballycroy Investments Limited as to the remaining 50% interest, in accordance with the terms and conditions contained in the said Agreement of Purchase and Sale. 2. That the Reeve and Clerk of the Township of Pickering be and are hereby authorized and instructed to execute, on behalf of the Corporation of the Township of Pickering, a Deed of the said lands to Orangebrook Developments Limited as to an undivided 508 interest and Ballycroy Investments Limited as to the remaining 50% interest. -2- 2. That this By-law shall in all respects be deemed to have come into force and effect as of and from the 25th day of June 1973. 3. By-law Number 313/75 be and the same is hereby repealed.
