A By-law of the Corporation of
the Town of Pickering to govern
the establishing, maintaining
and regulating of markets.
WHEREAS The Municipal Act, Chapter 284, Section 364 (3),
R.S.O. 1970, authorizes a Municipality to govern the sale of certain
classes of goods;
NOW THEREFORE the Council of the Corporation of the Town
of Pickering enacts as follows:
1. A Licence may be issued to the owner or tenant of land or
premises to establish a market upon payment of the fees prescribed
in Schedule "A" to this By-law and upon satisfaction of the terms
and conditions as set out herein.
2. No licence shall be issued until the land or premises to
be used for a market have been approved by:
(a) The Municipal Law Enforcement Officer
(b) The Building Inspector
(c) The Medical Officer of Health
(d) The Fire Chief
and such licence shall be subject to any rules and regulations that
may be prescribed by any of the aforesaid.
3. Any licence shall be valid only for the land and premises
specified in the licence and shall further be valid only for the days
of the week and the times of the day specified in the licence.
4. The holder of any licence shall be solely responsible for
the orderly conduct of the market and for the regulating of all
individual vendors that may make use of the market and for the main-
taining of the market in a sanitary condition and in a manner to
guarantee the safe and uninterrupted ingress and egress of the public.
5. Any licence granted under this By-law may be revoked if the
conditions under which the licence has been issued are not maintained
and further any licence granted under this By-law shall be revoked
upon the conviction of the holder of the licence or upon the conviction
of any individual vendor under the Crininal Code of Canada for an
infraction relating to the operation of the market or the conduct of
any vendor, agent or employee at the market.
6. Any licence issued under this By-law shall be valid only
from the date of its issued until the 31st day of December of the year
of its issue*.
7. No person or persons shall operate a market without having
obtained the necessary licence.
8. No person or persons shall sell or put up for sale goods,
wares, merchandise or any other articles in any market without the
express approval in writing of the holder of the market licence and
without satisfying himself of the validity of the market licence.
9. Any person committing any breach of any provision of this
By-law shall be guilty of an offence and shall, upon conviction thereof,
be liable to any penalty for each such breach of not more than Three
Hundred Dollars ($300.00) exclusive of costs, and any such penalty shall
be recoverable under the Ontario Summary Convictions Act, and in default
of payment to imprisonment in the common gaol for a period not exceeding
ten days, unless such fine and costs are sooner paid.

10. Notwithstanding any other provisions of this By-law, no
licence shall be required for an occasional market organized for
charitable or patriotic purposes provided that the organizers of
such an occasional market shall receive the approval by resolution
of the Council of the Corporation of the Town of Pickering.
11. All by-laws or parts of by-laws inconsistent with this
By-law are hereby repealed.
