BY-LAW NUMBER 150/75
Being a restricted area by-law to implement
the Official Plan of the Town of Pickering
in Part of Lot 22, Concession 1, Town of
Pickering.
WHEREAS the Council of the Corporation of the Town of Pickering
deems it desirable to further amend the provisions of By-law
3036;
NOW THEREFORE the Council of the Corporation of the Town of
Pickering ENACTS AS FOLLOWS:
Section 1: Schedules
Schedules "A", "B" and "C" attached hereto with notations
and references shown thereon are hereby declared to be
part of this By-law and are described as follows:
Schedule "A" - Liverpool-Finch'Zoning Map
Schedule "B" - Standards and Provisions
Schedule "C" - Building and Structure
Set-back Provisions.
Section 2: Area Restricted
The provisions of this By-law shall apply to all lands
enclosed by heavy black line on Schedule "A" attached hereto.
Section 3: General Prohibition
No building or land shall hereafter be used or occupied,
no building or part thereof, shall be erected, moved or
structurally altered, except in conformity with the
provisions of this By-law.
Section 4: Definitions
"Business and Professional office" shall mean any building
or part o a building use or t Re clerical function of an
enterprise and/or the practice of a profession.
"Restaurant" shall mean a building wherein food and drink
isa prov13_e3 for sale to the general public to be consumed
within the Restaurant building on the premises and shall
not include drive-in and take-out operations.
"Hm Improvement Centre" shall mean a building wherein
building ma er a s, accessories and hardware are displayed
and offered for sale to the general public.

"COVera e" shall mean that percentage of a property
covey buildings.
"Landscaped Open Space" steall mean that percentage of
a property not covered by buildings, driveways, parking
areas and sidewalks.
"Storey" shall mean that portion of a building (including
a went which is less than 506 below ground level)
between the surface of the floor, roof deck or ridge
above it. This shall not include a collar or attic.
"Gross Floor Area" shall mean the total floor area
o a Mors including basements.
Section 5: Provisions
The performance standards and provisions as set out on
Schedule "B" hereto shall apply to the area restricted
by this By-law.
Section 6
By-law No. 4449/73 be and the same is hereby repealed.
Section 7:_ By_law_3036
By-law 3036 as amended is hereby further amended only to
the extent necessary to give effect to the provisions of
this By-law.as it applies to the area set out in
Schedule "A" hereto. Definitions and subject matters
not specifically dealt with in this By-law shall be
governed by the provisions of By-law 3036, as amended.
Section 8: Enforcement
Any person convicted of a breach of any provision of this
By-law shall forfeit and pay, at the discretion of the
Convicting Magistrate, a penalty not exceeding (exclusive
of costs) the sum of Three Hundred Dollars ($300.00) for
each offence, recoverable under The Summary Convictions
Act.
Section 9: Effective Date
No part of this By-law shall come into force without the
approval of the Ontario Municipal Board, but subject to
such approval, the By-law shall take effect from the date
of passing thereof.
