Being a By-law to authorize the
execution of an Easement Agreement
between the Corporation of the Town of
Pickering and the Minister of the
Environment.
That Council of the Corporation of the Town of Pickering
ENACTS AS FOLLOWS:
THAT the Mayor and Clerk be authorized to execute an
Easement Agreement between the Corporation of the
Town of Pickering and the Minister of the Environment
covering the granting of an Easement for the portion
of the 401 Collector Trunk Sewer System (Block "H"
Plan M-1024)

2. (a) In consideration of tl)e still) of ____..._______....._. Dollars
of lawful money of Canada, now paid by the Crown to the Owner (the receipt of which is hereby acknowledged ), the
Owner hereby grants to the Crown the sale and exclusive--option, irrevocable within the time for exercise herein limited,
to purchase the following rights and casements over and with respect to the said property:
(i) To enter and lay down, install, construct, maintain, open, inspect, add to, alter, repair and keel) in good
condition, remove, replace, relocate, reconstruct, supplement and operate one or more sewer/water mains or any part
tlereof, including all appurtenance. T;c ortinc? a ge , in, across, under and through a strip of the said

(ii) To keep the .trip clear of all bn)sh, trees and other obstructions of any nature whatsoever as may be neces-
sary to the exercise and for the enjoyment of the rights and easements herein set forth;
(iii) For the servants, agents, contractors and workmen of and other persons duly authorized by the Crown at
all tines and from time to time to pass and repass with all plant, machinery. material, vehicles and equipment as may be
necessary along tl>< strip for all purposes necessary or incidental to the exercise and for the enjoyment of the rights and
casements herein set forth;
(iv) Upon the cc?inpletion of the construction of the aforesaid sewer/water n?ain or ,mains and of any instal-
lation, replacement, maintenance, inspection, repair, alteration or removal work subse4Ine„t thereto, the Crown shall
fill in all excavations in the strip and as far as practicable restore the surface thereof to the Sane conditiot) as that i,)
which it was found prior to the comn)encement of the work and shall remove all equipment and ruhhidh.
(v) To enter upon a strip, as shown on the attached sketch
outlined in blue, adjacent to the above "Strip", for
construction purposes, for a period not to exceed 12
months from the date of commencement of construction.
(b) The Crown shall indemnify the owner against, and hold
it harmless from any and all liability for damages on account
of injury to persons or damage to property resulting from
or arising out of or in any way connected with the operations
covered by this Agreement and shall reimburse the owner for
all costs, expenses and loss incurred by it in consequence
of any claims, demands and causes of action which may be
brought against it arising out of the operations covered by
the Agreement.
(c) The Crown hereby agrees to provide at its expense one
sanitary sewer service connection to the Owner's lands at
a point and to specifications to be agreed upon between the
parties. The Crown further agrees and does hereby grant
to the Owner the right to connect future sanitary sewers
servicing the Owner's lands herein to the sewermain herein.
The construction of the sanitary sewers will only be done
pursuant to the provisions of the Ontario Water Resources
Act and any other statutes, regulations or by-laws affecting
the construction and operation of such sewers.
(d) The Crown hereby agrees prior to the commencement of
any construction contemplated hereunder to advise Rockport
Holdings Limited and Eastcan Holdings Limited, carrying on
business under the firm name and style of Brock Developments,
of the nature and extent of the construction and to provide
to the owner evidence suitable to it that Brock Developments
has no objection to the construction, method of construction
or any other matter related thereto.

the expiration of a period of ??c?tt front the date of this agreement, and may he exercised by a letter, telegram or
other sinidar conimunication delivered to the Owner, left at the Owner's last known place of residence or mailed in a
stamped envelope addressed to the Owner at his last known place of residence. The exercise shall he effective when
delivered, left or mailed in the manner aforesaid.
4 In the event that this option is not exercised in the manner aforesaid, this agreement and ever,/thing herein con-
tained shall be null and void and no, longer binding upon any of the parties hereto, and the Crown shrill not he liable or
responsible for ant payments, expenses or damages and the Owner shall be entitled to retain the said sum paid as coit-
sideration for the granting; of this option.
S, lit the event of and upon the exercise of this option by the Crown, its agents or solicitors in the manner aforesaid
this option and the exercise thereof shall then become a binding contract of sale and purchase between the parties here-
to Inc! the same shall be completed upon the terms herein provided for. Provided that the title is good and free from all
e ncunibrances except such as, at the option of the Crown, the Crown may in writing expressly accept.
h. The purchase price of the said rights and easements shall be S2.00 a! the rate of
V"r ;Irt= for t he s:+id rights and casements. The sum of S1.0() »_r....?_ already paid
to the Owner as consideration for (fie granting of this option shall be credited to the frown and allowed as part of the
purchase price and t lie balance of the purchase price shall be payable by cheque on the completion of the sale.
7. The (Town, its agents or solicitors inay make requisitions on title at any time or times until the completion of the
sale and the Owner shall take such steps as may be necessary to satisfy such requisition or requisitions prior thereto. If
(lie Owner shall he unable to satisfy such requisition or requisitions the contract arising out of the acceptance of this
option stall, at the option of the Grown and notwithstanding any intermediate acts or negotiations in respect of such
requisition or requisitions, be null and void and all moneys paid to the Owner pursuant to the said contract (including
the suit paid for the granting of this option) shall be returned by the Owner without interest and the Crown shall not
be liable or responsible for any payments, expenses or damages.
S. Prior to Ilse completion of the sale the Crown may serve on the Owner, in the manner hereinbefore set forth for
the e\erci?e of this option, such description of the strip as may be determined by survey referred to in paragraph 20)
hereof together with a description of the rights and easements as the Crown in its sole discretion may deem expedient to
he prepared by and at the expense of the Crown, and thereupon the Crown and the servants, agents, contractors, and
workmen of, and other persons duly authorised by the Crown, or any of them, may enter upon and may use and enjoy
flit- said rights and easements for the purposes of the Crown.
9 1110 Contrarl of sale arising; from the exercise of this option shall be completed on a date to be determined by the
(Town, and to he notified to the Owner in the manner hereinbefore set forth for the exercise of this option. On the said
date the Owner will execute and deliver to the Crown a grant of the said rights and easements. The grant of the said
rights and easements is to he prepared at the expense of the Crown and is to be on the Crown's form 13-131. The
(Town will supply to the (honer, at the expense of the Crown, a copy of the survey made of the final location of the
strip as referred to in paragraph 2(l ) hereof.
10 In the event Ihat the Crown should, after the date of the execution of this agreement and prior to the exercise by
it of the option granted herein, obtain the above-mentioned rights and easements over and with respect to the said
property by expropriation rather than by the exercise of the option granted herein, the Owner hereby agrees to execute
the (Town's usual form entitled, "General Release of All Demands" in consideration of the same sum as the purchase
price of I he said rights and easements contained in paragraph 6 hereof.
1 1 . The Owner covenants and agrees with the Crown to do nothing to encumber the said land after the execution of

13. This ag;reenient shall enure to the benefit of and be binding upon the parties hereto, their respective heirs, execu-
lors, adininislrators, successors and assigns.
