Being a By-law of the Corporation
of the Town of Pickering to
authorize the execution of an
agreement between the Corporation
of the Town of Pickering and
The Pickering Panthers Junior
Hockey Inc. with respect to the
rental of the Don Beer Sports Arena
for the 1976/77 Season
The Council of the Corporation of the Town of Pickering HEREBY ENACTS
AS FOLLOWS:
1. That the Mayor and Administrator-Clerk be
authorized to execute an agreement between the
Corporation of the Town of Pickering and The
Pickering Panthers Junior Hockey Inc. with
respect to the rental of the Don Beer Sports
Arena for the 1976/77 Season

THIS AGREEMENT made the day of A.D., 1976.
B E T W E E N:
THE CORPORATION OF THE TOWN OF PICKERING,
hereinafter called the "Town",
OF THE FIRST PART,
- and -
THE PICKERING PANTHERS JUNIOR HOCKEY INC.,
hereinafter called the "Panthers",
OF THE SECOND PART.
NOW THIS AGREEMENT WITNESSETH that in consideration of the sum
of TWO ($2.00) DOLLARS of lawful money of Canada paid by the
Panthers to the Town, the receipt whereof is hereby acknowledged
and other good and valuable consideration:
1. The Panthers hereby agree as follows:
(a) To pay a rental fee to the Town of $32.50 per hniir
for all practices, and $42.50 per hour for ill
playoff, regular season and exhibition games.
(b) To provide and pay for all police, ticket takers,
parking lot attendants, ushers, and all other
personnel required over and above Town regular
arena staff. Town staff shall have the power to
direct hockey clubs personnel when a situation may
cause vandalism to the Town premises.
(c) To provide a $250.00 Performance Bond to be paid
to the Town of Pickering before the start of the
1976-1977 Hockey Season.
(d) To pay all rental monies one week in advance.
(e) To be responsible for the payment of all time
allocated, whether used by the Panthers, or by a
team(s) designated by the Panthers.
(f) To secure all other time required for O.H.A.
games, not provided by this agreement, through
negotiations with hockey, ringette, or figure
skating
b organizations to which the time had
een previously designated. Rental fees to be at
the rates established by this agreement. The
Town to be notified of such alterations.
(g) To pay all Ontario Hockey Association's (O.H.A.)
fees related to regular season and playoff games,
including bonds, percentage of gate, receipts,
registration fees, etc., and to keep the Town
free from any costs originating from the O.H.A.
(h) To ensure that games conclude by 10:00 p.m.
to enable the continuation of the Town of
Pickering arena rental programme.
(i) To pay the operating costs of the gas heaters in
Pad No. 1 if required during their rental periods.

(j) The designated Ice Time for the Panthers will be
as follows:
MONDAY - Practice Time - 9:30 - 11:00 p.m. Pad #2
WEDNESDAY - Practice Time - 6:00 - 7:30 p.m. Pad #1
FRIDAY - Game Time - 7:00 - 10:00 p.m. Pad #1
When required as set out in Schedule "A" hereto.
In the event the O.H.A. Schedule does not permit
all the home game nights to be on Fridays, the
Panthers will be required to meet with whatever
Town Association has the arena time at the Don Beer
Sports Arena which the Panthers require. It is
understood however that this in no way binds or
requires the affected Town Association to give up
its scheduled time. The Panthers further agree
that if they are able to reach a satisfactory
arrangement it will pay the Town the rates as set
out in paragraph (a) and to notify the Town of such
arrangements.
(k) To rent arena titte in the months of March and April,
1977, only if the O.H.A. schedule or playoffs
necessitate such rental.
2. The Town hereby agrees as follows:
(a) To hold the following arena time for the Pickering
Panthers Jr. Hockey Inc. each week, and to have
the teams concerned on the playing surface as
close to the time allotted as possible.
MONDAY - 9:30 p.m. -11:00 p.m. - Pad #2
WEDNESDAY - 6:00 p.m. - 7:30 p.m. - Pad #1
FRIDAY - 7:00 p.m. -10:00 p.m. - Pad #1
(b) To provide the use of adequate lighting, goal nets,
public address system, time clocks, player benches,
penalty benches, goal judges lights, Canadian Flag
and dressing rooms for teams.
(c) To provide the Panthers the use of two (2) rooms
on game nights, exhibition games and practices.
(d) To allow the Panthers the right to sub-let their
arena time to other hockey teams at a rate not
greater than that charged by the Town.
(e) To notify the Panthers as to when the season
will close or at such times as a legal holiday
may interefere with the regular schedule as set
out in Schedule "A" hereto.
(f) All persons and property at any time on the
premises rented by the Panthers, when rented by
the Panthers, shall be at the sole risk of the
Panthers, and the Town shall not be liable for
any loss, damage, or injury (including loss of
life) to them or it however occurring, unless
caused or contributed to by the neglect or
default of the Town.
(g) To provide the Panthers an equipment lock-up room
of adequate size.
(h) To provide the arena ticket booth on game nights
(i) To provide an area for the sale of programmes and
for promotions of future games on game nights
during the term of this Agreement.

(j) To provide clearly marked ice at all times as per
standards.
(k) To provide the O.H.A. Officials with a dressing
room on game nights with adequate washroom and shower
facilities along with first aid supplies and
equipment.
(1) To create a good working relationship with the
Panthers' management, staff and players.
(m) To maintain the snack bar as a service to the
public during Panther games.
3. Attached hereto and marked as Schedule "A" is the 1976-
1977 Ontario Hockey Association Schedule which shall
form a part of this Agreement.
4. The term of this agreement shall be until the completion
of the Panthers' 1976-1977 schedule, including playoffs,
as shown on Schedule "A". It is agreed between the
parties however that the Panthers shall have the option
to renew this Agreement for the 1977-1978 season subject
to such terms and conditions as may be agreed upon
between the parties hereto.
5. This Agreement and everything contained herein shall
ensure to the benefit of and be binding upon the parties
hereto and their heirs, executors, administrators and
assigns.
IN WITNESS WHEREOF the parties hereto have affixed their
corporate seals, attested by their officers duly authorized in
that behalf.
