Being a By-law of the Corporation
of the Town of Pickering to
authorize the execution of an
agreement between the Corporation
of the Town of Pickering and the
Regional Municipality of Durham
with respect to the granting of
a right-of-way over the Day Care
Centre property on Radom Street
for access to the Bay Ridges

The Council of the Corporation of the Town of Pickering HEREBY
ENACTS AS FOLLOWS:
1. That the Mayor and Administrator-Clerk be
authorized to execute an agreement between
the Corporation of the Town of Pickering and
the Regional Municipality of Durham with
respect to the granting of a right-of-way
over the Day Care Centre property on Radom
Street for access to the Bay Ridges Community
Centre.
By-law read a first, second and third time and passed this

B E T W E E N:
THE REGIONAL MUNICIPALITY OF DURHAM
Hereinafter called the "GRANTOR"
of the first part
-and-
THE CORPORATION OF THE TOWN OF PICKERING
Hereinafter called the "GRANTEE"
of the second part
WITNESSETH that in consideration of other good and valuable
consideration and the sum of TWO------------------- ($2.00) ------------
DOLLARS of lawful money of Canada now paid by the said Grantee to the
said Grantor (the receipt whereof is hereby by it acknowledged),
the said Grantor doth grant to the said Grantee a right-of-way for
persons and vehicles over the lands shown outlined in red on the Plan
attached hereto and marked as Schedule "A" for the purpose of secondary
access to the proposed Community Centre and Library addition to Bay
Road School in the Town of Pickering;
THE GRANTEE hereby covenants and agrees with the Grantor to
indemnify and save harmless the Grantor from any and all claims arising
out of the use of the lands herein by persons or vehicles for the
purpose of access to the said Community Centre and Library addition
to Bay Road School in the Town of Pickering;
THE GRANTEE hereby covenants and agrees with the Grantor that
it will install a proper cement curb and relocate the chain link
fence on the westerly side of the lands herein.
IT IS UNDERSTOOD that this grant of right-of-way shall terminate
if the right-of-way is used otherwise than for the purpose of a
secondary access to the proposed Community Centre and Library addition
to the Say Road School in the Town of Pickering.
IN WITNESS WHEREOF the parties hereto have hereunto set their
Corporate Seals attested by the hands of their proper signing
officers duly authorized in that behalf.
