Ontario Municipal THE CORPORATION OF THE TOWN OF PICKERING Board, January 9, 1979 File R.7910 BY-LAW NUMBER 890/78 Being a Restricted Area By-law to amend Restricted Area By-law 3036, as amended, to implement the official Plan of the Town of Pickering District Planning Area, Region of Durham, in Part Lot 22, Concession 2, Town of Pickering. WHEREAS the Council of the Corporation of the Town of Pickering deems it desirable to permit the development of a retirement home in part of Lot 22, Concession 2 of the Town of Pickering; AND WHEREAS an amendment to By-law 3036 is therefore deemed necessary; NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE TOWN OF PICKERING HEREBY ENACTS AS FOLLOWS: SECTION 1: BY-LAW 3036 By-law 3036, passed by Council of the Corporation of the Township (now Town) of Pickering on the 3rd day of August, 1965, and approved by the Ontario Municipal Board on the 7th day of October, 1966, and amended from time to time is hereby further amended to the extent necessary to give effect to the provisions of Sections 2 and 3 hereof. SECTION 2: TEXT AMENDMENT (a) Section 2 of the said By-law is. hereby further amended by adding thereto the following subsection: 2.64.1 RETIREMENT HOME "Retirement Home" shall mean a building containing more than four (4) dwelling units, each unit having access from an internal corridor system, for occupation by retired persons, and that is developed and owned by a public agency, service club, church, or any other non-profit organization. (b) Section 7 of the said By-law is hereby further amended by adding thereto the following subsection: 7.5.6 Exception - Part Lot 22, Concession 2 Nothwithstanding the provisions of Section 7.1 hereof, the lands designated A-1 on Schedule "A" hereto and located in Part of Lot 22 Concession 2 may be used for the purpose of a retirement home in accordance with the provisions of section 7.2.2 hereof. SECTION 3: SCHEDULE "A" AMENDMENT Schedule "A" to By-law 3036, as amended, is hereby further amended by altering from 'A' to 'A-1' the zone designation of the lands designated A-1 on Schedule "A" attached hereto. SECTION 4: EFFECTIVE DATE No part of this By-law shall come into force without the approval of the Ontario Municipal Board but, subject to such approval, this By-law shall take effect from the day of passing thereof.
