BY-LAW NUMBER 861/78
Being a By-law to amend By-law Number
55/74 prohibiting heavy traffic.
WHEREAS By-law Number 55/74 prohibits heavy traffic on
certain highways within the Municipality, and
WHEREAS it is deemed expedient to restrict further high-
ways from heavy traffic,
NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE TOWN
OF PICKERING HEREBY ENACTS AS FOLLOWS:
1. Section 2 of By-law Number 55/74, as amended by
By-laws Numbered 140/74, 438/76 and 509/76 is
hereby further amended by adding thereto the
following:

Finch Avenue Kingston Road
(Highway #2)
2. This By-law shall not take effect until approved
by the Regional Municipality of Durham.

PRC4{IBITING HEAVY TRAFFIC
WUKHFAS under the provisions of subsection 1, ptu aP,rnph 10'i, section 354
of The Municipal Act (R.S.O. 1970, Chapter 28h) the councils of cities,
towns, villages, police villages and townships may pass by-laws prohibiting
heavy traffic on highways under their jurisdiction;
AND WHEREAS the Council of the Corporation of Pni.?_o?3lcyPrinn
deems it expedient to prohibit heavy traffic on ecrt.ai.n highways;
1,1014 THEREFORE the Council of the Corporation of Town_Qf P tiring
enacts as follows:-
1. In this by-law "heavy traffic" means the use of a \
highway by a vehicle, object or contrivance for moving
loads, having a gross weight, including the vehicle,
object or contrivance and load, in excess of '5 tons
2. When properly worded signs have been erected and are
on display, heavy traffic is prohibited on the highways
or parts of highways named hereunder:-

3. The provisions of this by-law shall not extend to the use
of the said highways or parts of highways for deliveries
to or removals from any premises abutting thereon, to
ambulances, to police or fire department vehicles, to
public utility eaergency vehicles, to vehicles actually
engaged in works undertaken for or on behalf of the
Corporation, or to a privately-o•.med vehicle driven to
or from the owner's residence.
h, Any person violating any of the provisions 'of this by-law
shall be subject to a,\penalfy of
exclusive of costs, and all such penalties shall be
recoverable under the Ontario Summary Convictions Act.
5, This by-law shall not become effective until approved by
the Ministry of Transportation and Co-sunications.
