BY-LAW NUMBER 835/78
Being a By-law to authorize the execution
of a Site Plan Agreement between the Cor-
poration of the Town of Pickering and
Vivian Kahn with respect to Part of Lots
7 and 8, Concession 6, Pickering (LD 110/78)
WHEREAS pursuant to the provisions of a Decision dated April
10, 1978 of the Land Division Committee of the Regional
Municipality of Durham an Agreement is required to be entered
into respecting the severance of Part of Lots 7 and 8,
Concession 6, Pickering;
NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE TOWN
OF PICKERING HEREBY ENACTS AS FOLLOWS:
1. The Mayor and Clerk are hereby authorized
to execute a Site Plan Agreement in the
form attached hereto as Schedule "A" between
Vivian Kahn and the Corporation of the Town
of Pickering respecting Part of Lots 7 and
8, Concession 6, Pickering (LD 110/78).
BY-LAW read a first, second and third time and finally
passed this 19th day of June , 1978.

THIS AGREEMENT made in duplicate this day of
B E T W E E N:
THE CORPORATION OF THE TOWN OF PICKERING
hereinafter referred to as the "Town"
- and -
OF THE FIRST PART
VIVIAN KAHN
hereinafter referred to as the "Owner"
OF THE SECOND PART
WHEREAS the Owner is the owner in fee simple of
certain lands and premises more particularly described in
Schedule "A" hereto;

AND WHEREAS the Owner wishes to deal with those lands
and premises in a certain manner;
AND WHEREAS the Owner is therefore required by
Decision, dated the 10th day of April, 1978, of the Land
Division Committee of the Regional Municipality of Durham to
enter into a certain agreement or agreements with the Town;
NOW THEREFORE THIS AGREEMENT WITNESSET THAT, in
consideration of mutual benefits, the Parties hereto agree
as follows:
1. The lands and premises affected by this Agreement are
those lands and premises more particularly described in Schedule
"A" hereto.
2. The Owner agrees that no human habitable structure
shall be permitted on the lands affected hereby other than non-
residential structures specifically for agricultural uses and
that the owner shall not use any structure on the lands affected
hereby for human habitation.
3. The Owner further agrees that further severance of
the lands affected hereby shall not be applied for until such
time as Municipal sewer and water services have been made
available to the said lands.
4. This Agreement and everything contained herein
shall enure to the benefit of and be binding upon the Parties
hereto, their heirs, successors and assigns.
IN WITNESS WHEREOF the Party of the First Part
has hereto affixed its corporate seal attested by the hands of
its duly authorized officers and the Party of the Second Part
has hereto affixed her hand and seal.
