THE CORPORATION OF THE TOWN OF PICKERING

BY-LAW NUMBER 818/78
Being By-law of the Corporation
of the Town of Pickering to stop
up a part of the road allowance
between Lots 10 and 11 in Concess-
ion 5 and to authorize the sale of
that part of the said road to abut-
ting property owners.
WHEREAS pursuant to the provisions of subsection 1 of
section 443 of The Municipal Act, R.S.O. 1970, chapter
284, the Council of any municipality may pass by-laws
to stop up a highway or part thereof and to sell parts
of stopped-up highways;
AND WHEREAS it is deemed expedient to stop up that part
of the road allowance between lots 10 and 11, in Concess-
ion 5 designated as Part 2 on Plan of Reference 40R-4274;
AND WHEREAS notice of this by-law has been published
once a week for four consecutive weeks and the provis-
ions of The Municipal Act relating to the stopping-up
of a highway have been complied with;
NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE TOWN
OF PICKERING HEREBY ENACTS AS FOLLOWS:
1. The Lands described in Schedule "A" attached hereto
are hereby stopped-up as a public highway.
2. For the purpose of illustration only, a plan show-
ing the lands described in Schedule "A" and
designated as Part 2 on Plan of Reference 40R-4274
is attached hereto as Schedule "B".
3. The lands described in Schedule "A" attached here-
to shall be offered for sale to the abutting prop-
erty owners at a price of $1.00;
And further that should an abutting property owner
accept such an offer then in that event the Mayor
and Clerk are hereby authorized to execute the
necessary documentation to effect the transfer.
4. This by-law shall not take effect until approved
by the Regional Municipality of Durham and regis-
tered in the Registry Office for the Registry
Division of Durham.

May 1978.

All and singular that certain parcel or tract of land or
premises, situate, lying or being in the Town of Pickering
in the Regional Municipality of Durham and being composed
of that part of the road allow ance between Lots 10 and 11 in
Concession 5 designated as Part 2 on a plan of survey of
record filed in the Registry Office for the Registry Division
of Durham (No. 40) as Number 40R-4274
