BY-LAW NO. 786/78
Being a By-Law to amend By-Law 112/74
regulating self-serve gasoline
facilities
WHEREAS the Council of the Corporation of the Town of Pickering
enacted By-Law 112/74 on September 16th, 1974 to regulate self-serve
gasoline facilities;
AND WHEREAS it is deemed advisable to amend certain provisions
of the said By-Law;
NOW THEREFORE, the Council of the Corporation of the Town of
Pickering HEREBY ENACTS AS FOLLOWS:
1. Section 12 of By-Law 112/74 is hereby revoked and the follow-
ing substituted therefor:
At every location where self-serve gasoline
facilities or self-serve gasoline equipment
is installed, there shall be prominently
displayed at each dispenser, legible signs,
7-1/4 inches by 3-3/4 inches, bearing the
following warning:
WARNING: TO AVOID SPILLAGE EASE
UP ON THE NOZZLE TRIGGER
WHEN FILLING THE TOP
PORTION OF THE TANK.
Such signs installed shall be coloured black
on yellow ground, the colours to conform to
CGSB Specifications 1-GP-12c Code 505-101 or
505-301 for "Safety Yellow" and Code 512-101,
201 or 301 for "Traffic Sign Black".
2. Section 13 of the said By-Law is hereby revoked and the follow-
ing substituted therefor:
At every location where self-serve gasoline
facilities or self-serve gasoline equipment
is installed, the console shall be so loca-
ted that the operator has an unobstructed
view of all self-serve pumps. Where the
layout of pump islands does not permit the
operator to see all dispensing nozzles from
the console position, regardless of the
position in which they are being used, means
shall be provided to achieve full surveil-
lance of dispensing operations. No dispens-
ing equipment shall be located more than 60
feet from the console, nor shall it be
installed so that the angle of vision over
which the operator must keep surveillance
is greater than 140 degrees.

3. Section 16 of the said By-Law is hereby revoked and the follow-
ing substituted therefor:
(1) Every console operator shall be a com-
petent, trained employee, instructed
in recognition of hazards and in meth-
ods of dealing with emergency situa-
tions.
(2) Each console operator shall be provided
by the owner of the facility with a man-
ual outlining,
(a) safety requirements
(b) preventative maintenance proced-
ures
(c) fire prevention and spill preven-
tion procedures
(d) emergency procedures.
4. Section 17 of the said By-Law is hereby revoked and the follow-
ing substituted therefor:
It shall be the responsibility of the con-
sole operator:
(a) To ensure compliance with Section
8(23) and Section 9(2) of The
Gasoline Handling Code,
(b) To ensure compliance with Section
3 of The Gasoline Handling Act,
R.S.O. 1970, chapter 189, as
amended from time to time,
(c) To shut down any dispenser at which
contraventions of the above require-
ments are occurring until the situa-
tion has been corrected.
BY-LAW read a first, second and third time and finally passed this
3rd day of April , 1978.
