PICKERING Being a Restricted Area By-law to amend Restricted Area By-law 3036, as amended, and to implement the Township of Pickering Official Plan on Block A, Plan M-1057, in the Town of Pickering. WHEREAS it is deemed expedient to permit the development of semi-detached dwellings to occur on the subject lands; NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE TOWN OF PICKERING HEREBY ENACTS AS FOLLOWS:- SECTION 1: SCHEDULES Schedules "A" and "B" hereto with notations and references shown thereon are hereby declared to be part of this By-law and are described as follows:- Schedule "A" - Cobbler's Court - Edgewood Road Zoning Map Schedule "B" - Standards and Provisions SECTION 2: AREA RESTRICTED The provisions of this By-law shall apply to all lands designated "SD" on Schedule "A" attached hereto. SECTION 3: GENERAL PROVISIONS No building, land or part thereof shall hereafter be used, occupied, erected, moved or structurally altered except in conformity with the provisions of this By-law. SECTION 4: DEFINITIONS "Building Height" shall mean the vertical dimension of a building measure rom the average elevation of the finished grade at the front wall of the building to the base of the eaves of the said building. "Dwellin shall mean one or more habitable rooms, occupied or capa le o being occupied as a single independent and separate housekeeping unit containing a separate kitchen and sanitary facilities. -"Semi-Detached Dwelling" shall mean one of a pair of attached dwellings that are attached horizontally in whole or in part above and/or below grade and are separated from other buildings by yards. "Lot Frontage" shall mean the width of a lot between the side lot lines measured along a line parallel to and 20 feet distant from the front lot line. "Floor Area" shall mean the total area of all storeys contained within the outside walls of a building excluding, in the case of a dwelling, any private garage, porch, veranda, sunroom, balcony, basement recreation room or unfinished attic or basement. "Private Garage" means an enclosed or paritally enclosed structure for the storage of one or more vehicles, in which no business or service is conducted for profit or otherwise. continued...2 Page 2 "Yards" - "Front Yard" shall mean the space between the main- front wall of a building and and the front lot line extending the full width of the lot. - "Side Yard" shall mean the space between a main side wall of a building and a side lot line, extending from the front yard to the rear yard. - "Rear Yard" shall mean the space between the main rear wall of a building and the rear lot line, and extending the full width of the lot. - "Flank age Yard" shall mean the space between a main n ii of t e building and a side lot line bounding on a public street and extending from front yard to rear yard. SECTION 5: PROVISIONS The standards and provisions as set out on Schedule "B" attached hereto shall apply to the area restricted by this By-law. SECTION 6: BY-LAW 3036 By-law 3036, as amended, is hereby further amended only to the extent necessary to give effect to the provisions of this By-law as it applies to the area set out in Schedule "A" attached hereto. Definitions and subject matters not specifically dealt with in this By-law shall be governed by the provisions of Sections 1, 2, 3, 4, 5, 6, 19 and 20 of By-law 3036 as amended. SECTION 7: ENFORCEMENT Any person who contravenes any of the provisions of this By-law shall be liable upon conviction thereof to a fine not exceeding $1,000.00 for each offence, exclusive of costs, recoverable under The Summary Convictions Act. SECTION 8: EFFECTIVE DATE No part of this By-law shall come into force without the approval of the Ontario Municipal Board but subject to such approval of the By-law shall take effect from the date of the passing hereof.
