BY-LAW NUMBER 9$1/79
Being a Restricted Area By-law to amend Restricted
Area By-law 3036, as amended, to implement the
Official Plan of the Town of Pickering District
Planning Area, Region of Durham, in Part Lot 17,
Concession 2, Town of Pickering, and in Part of
the Road Allowance between Lot 17, Concession 2,
Town of Pickering and Lot 16, Concession 2, Town
of Ajax.
WHEREAS the Council of the Corporation of the Town of
Pickering deems it desirable to permit the operation of a
seasonal camping establishment on the subject lands, being
part of Lot 17, Concession 2, Town of Pickering, and part of
the Road Allowance between Lot 17, Concession 2, Town of
Pickering and Lot 16, Concession 2, Town of Ajax;
AND WHEREAS an amendment to By-law 3036 is therefore deemed
necessary;
NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE TOWN OF
PICKERING HEREBY ENACTS AS FOLLOWS:

By-law 950/79, passed by the Council of the
Corporation of the Town of Pickering on the 5th day
of February, 1979, is hereby repealed.
BY-LAW 3036
By-law 3036, passed by the Council of the Corporation
of the Township (now Town) of Pickering on the 3rd
day of August, 1965, and approved by the Ontario
Municipal Board on the 7th day of October, 1966, and
amended from time to time, is hereby further amended
only to the extent necessary to give effect to the
provisions of this By-law.
TEXT AMENDMENT
(a) Section 2 of By-law 3036, as amended, is hereby
further amended by adding thereto the following
subsection:
2.64.2 SEASONAL CAMPING ESTABLISHMENT
"Seasonal Camping Establishment" shall mean
lands and premises used or maintained for
camping, including the parking of trailers,
mobile homes, or tents, which lands and premises
are duly licensed pursuant to The Tourism Act,
or any successor thereto, and which establishment
is not in operation within the periods between
January 1 and May 15, inclusive, and between
October 16 and December 31, inclusive, in each
calendar year.
(b) Section 16 of By-law 3036, as amended, is hereby
further amended by adding thereto the following
subsection:
16.3 Exception
16.3.1 Part Lot 17, Concession 2, and Part of the Road
Allowance between Lot 17, Concession 2, Town of
Pickering and Lot 16, Concession 2, Town of Ajax.
Notwithstanding the provisions of Section 16.1
or Section 16.2 hereof, the lands designated
"02-1" on Schedule "I" to By-law 981/79
and located in part of Lot 17, Concession 2,
Town of Pickering, and in part of the Road
Allowance between Lot 17, Concession 2, Town of
Pickering, and Lot 16, Concession 2, Town of Ajax,
may be used for the purpose of a seasonal camping
establishment.
SCHEDULE "A" AMENDMENT
Schedule "A" to By-law 3036, as amended, is hereby further
amended by altering from "R3" to "02-1" the zone
designation of the lands designated 02-1 on Schedule "I"
hereto and located in part of Lot 17, Concession 2, Town
of Pickering, and in part of the Road Allowance between
Lot 17, Concession 2, Town of Pickering, and Lot 16,
Concession 2, Town of Ajax.
EFFECTIVE DATE
No part of this By-law shall come into effect without the
approval of the Ontario Municipal Board, but subject to
such approval this By-law shall take effect from the day
of passing hereof.
A FIRST AND SECOND TIME THIS 17th DAY OF April , 1979.
A THIRD TIME AND PASSED THIS 17th DAY OF April , 1979.
