BY-LAW NO. 974 /79
Being a by-law to authorize the execution
of a release of Dalmeco Developments Limited
from a Subdivision Agreement respecting Plan
M-962 and M-963.
WHEREAS, by Instrument dated May 1st, 1972 and registered
November 8th, 1972, as Instrument No. 35940, Dalmeco Developments
Limited and the Corporation of the Township (now Town) of Pick-
ering entered into an Agreement for the purposes of the subdivi-
sion and development of certain lands in the Township (now Town)
of Pickering (Plans M-962 and M-963); and
WHEREAS, Dalmeco Developments Limited as complied with
all of its obligations pursuant to the said Agreement to the
satisfaction of the Town of Pickering; and
WHEREAS it is now deemed expedient to release Dalmeco
Developments Limited, its successors and assigns, from the pro-
visions of the said Agreement;
NOW THEREFORE, the Council of the Corporation of the Town
of Pickering HEREBY enact as follows:
1. The Mayor and Clerk are hereby authorized to execute
a release, in the form attached hereto as Schedule
"A", of Dalmeco Developments Limited from a Subdi-
vision Agreement respecting Plan M-962 and M-963.
BY-LAW read a first, second and third time and finally passed
this 2nd day of April , 1979.

RELEASE
V7HEREAS, by Instrument dated May 1st, 1972 and registered
in the Office of Land Titles at Whitby on November 8th, 1972,
as Instrument No. 35940, Dalmeco Developments Limited and the
Corporation of the Township (now Town) of Pickering entered
into an Agreement for the purposes of the subdivision of cer-
tain lands in the Township (now Town) of Pickering, which lands
are more particularly described below; and
WHEREAS, pursuant to the provisions of that Agreement, the
Parties thereto and their respective successors and assigns are
bound by it; and
WHEREAS, pursuant to the provisions of The Regional Muni-
cipality of Durham Act, 1973, the Corporation of the Town of
Pickering is the successor in law to the Corporation of the
Township of Pickering; and
WHEREAS, Dalmeco Developments Limited has complied with
all of its obligations pursuant to the said Agreement, to the
satisfaction of the Town of Pickering;
NOW THEREFORE, the Corporation of the Town of Pickering
hereby releases Dalmeco Developments Limited, its successors
and assigns, from any and all obligations of any kind whatso-
ever arising from the provisions of the said Agreement dated
May 1st, 1972, between Dalmeco Developments Limited and the
Corporation of the Township of Pickering with respect to the
lands and premises more particularly described as follows:
ALL AND SINGULAR that certain parcel or tract
of land and premises situate, lying and being
in the Town (formerly Township) of Pickering
in the Regional Municipality of Durham (form-
erly County of Ontario) and being composed of
the whole of Lots 1-28, inclusive, according
to a plan filed in the office of Land Titles
at Whitby as Plan M-962, and the whole of
Block A and Lots 29-46, inclusive, according
to a plan filed in the said office as Plan
N,-963.
IN WITNESS WHEREOF the Corporation of
