Being a Restricted Area By-law to amend Restricted
Area By-law 2511, as amended, to implement the
Official Plan of the Town of Pickering District
Planning Area, Region of Durham, on Blocks E and F
Plan 239, and part of St. Martin's Drive (Part 1,
Plan 40R-590), in the Town of Pickering.
WHEREAS the Council of the Corporation of the Town of Pickering
deems it desirable to permit the establishment of a senior
citizens apartment dwelling, in addition to the existing
church, on the subject lands being Blocks E and F, Plan 239,
and part of St. Martin's Drive (Part I. Plan 40R-590) ;
AND WHEREAS an amendment to By-law 2511, as amended, is
therefore deemed necessary;
NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE TOWN OF
PICKERING HEREBY ENACTS AS FOLLOWS:
1. SCHEDULES "I" AND "II"
Schedules"I" and "II" hereto with notations and references
thereon are hereby declared to be part of this By-law.
2. AREA RESTRICTED
The provisions of this By-law shall apply to those
lands in Blocks E and F,-Plan 239 and part of St. Martin's
Drive (Part 1, Plan 40R-590), Pickering, designated
"I(C) - R(SC)" and "02" on Schedule "I" attached hereto.
3. GENERAL PROVISIONS
No building, land or part thereof shall hereafter be
used, occupied, erected, moved or structurally altered
except in conformity with the provisions of this By-law.
4. DEFINITIMS
a) (i) "Dwelling" shall mean a building or part of a
Building containing one or more dwelling units.
(ii) "Dwelling Unit" shall mean one or more habitable
rooms occupied or capable of being occupied as a
single, independent and separate housekeeping unit
containing a separate kitchen and sanitary facilities.
(iii) "Senior Citizens Apartment Dwelling„ shall mean a
dwelling containing four or more dwelling units
attached horizontally or vertically for occupation
by elderly persons.
b) (i) "Floor Area" shall mean the area of the floor surface
contained within the outside walls of a storey or
part of a storey.
(ii) "Dwelling Unit Area" shall mean the aggregate of the
floor area of all habitable rooms of a dwelling unit.
c) "Lot Coverage" shall mean the percentage of lot area
covered by all buildings on the lot.

5. PROVISIONS
5.1.A.Uses Permitted ("I (r) - R(SC)" Zone)
No person shall within the lands designated "I(C)-R(SC)"
on Schedule "I" hereto, use any lot or erect, alter or
use any building o.r structure for any purpose except the
following:
a) church
b) senior citizen apartment dwelling
5.1.B.Zone Requirements ("I(C) - R(SC) " Zone)
No person shall within the lands designated "I(C)-R(SC)"
on Schedule "I" hereto, use any lot or erect, alter or
use any building or structure except in accordance with
the following provisions:
a) YARD REQUIREMENTS:
b) LOT COVERAGE (maximum):
c) BUILDING HEIGHT (maximum):
d) DWELLING UNIT AREA (minimum)
e) DWELLING UNITS PER LOT
(maximum):
f) PARKING REQUIREMENTS PER LOT
(minimum):
as set out on Schedule

(i) church: 1 space per 4 persons capacity
(ii) senior citizens apartment dwelling: 1 space per
4 dwelling units
g) SUPPLEMENTARY PARKING REGULATIONS:
(i} Notwithstanding section 5.21.2(a) of By-law
251,1, as amended, all parking spaces may be
located in the front yard
(ii) Notwithstanding section 5.21.2(67 -if By-law
2511, as amended; sideyard parking may be
permitted no closer than 1.5 metres from any
side lot line
5.2.A.Uses Permitted and Zone Requirements ("02" Zone
No person shall within the lands designated "02" on
Schedule "I" hereto, use any lot or erect, alter or
use any building or structure for any purpose except
in accordance with the provisions of section 20 of
By-law 2511, as amended.
6. BY-LAW 2511
By-law 2511, as amended, is hereby further amended only
to the extent necessary to give effect to the provisions
of this By-law as it applies to the area set out in
Schedule "I" attached hereto. Definitions and subject
matters not specifically dealt with in this By-law
shall be governed by the relevant provisons of By-law
2511, as amended.

7. ENFORCEMENT
Any person who contravenes any of the provisions of
this By-law shall be liable upon conviction thereof
to a fine not exceeding $1,000.00 for each offence,
exclusive of costs, recoverable under The Provincial
Offences Act, 1979.
8. EFFECTIVE DATE
This By-law shall take effect from the day of passing
hereof subject to the approval of the Ontario Municipal
Board, if required.
