BY-LAW NO. 1149/80
Being a By-Law to authorize the execution
of an Agreement between Christiaan and
Adriana Huyer and the Corporation of the
Town of Pickering respecting the future
development of Lot 90, Plan 1051 (LD 433/79)
WHEREAS by Decision dated November 26th, 1979, the
Regional Municipality of Durham Land Division Committee
approved the severance of the above plan subject to
several conditions, one of which requires that an Agree-
ment be entered into respecting the future development
of the lands to be retained;
NOW THEREFORE, the Council of the Corporation of the
Town of Pickering HEREBY ENACTS AS FOLLOWS:
1. The Mayor and Clerk are hereby authorized to execute
an Agreement, in the form attached hereto as Schedule
"A", between Christiaan and Adriana Huyer and the
Corporation of the Town of Pickering respecting the
future development of Lot 90, Plan 1051 (LD 433/79).
BY-LAW read a first, second and third time and finally passed
this 7th day of July , 1980.

THIS AGREEMENT made in triplicate this 7th day of July,
1980.
B E T W E E N:
THE CORPORATION OF THE TOWN OF PICKERING
hereinafter referred to as the "Town"
OF THE FIRST PART
- and -
CHRISTIAAN HUYER, Plant Foreman
and
ADRIANA HUYER, his wife, as joint tenants
hereinafter referred to'as the ^Owners"
OF THE SECOND PART.
WHEREAS the Owners are the owners in fee simple of cer-
tain lands and premises more particularly described in
Schedule "A" hereto, which Schedule is a part of this Agree-
ment; and
WHEREAS the Owner wishes to deal with those lands and
premises in a certain manner; and
WHEREAS the Owner is therefore required by Decision,
dated the 26th day of November, 1979, of the Land Division
Committee of the Regional Municipality of Durham to restrict
the future development of the retained lands to development
by plan of subdivision only;
NOW THEREFORE, THIS AGREEMENT WITNESSETH THAT, in
consideration of mutual benefits, the Parties hereto agree
as follows:
1. The lands and premises affected by this Agreement
(the "subject lands") are those lands and prem-
ises more particularly described in Schedule "B"
hereto, which Schedule is hereby made a part of
this Agreement.

2. No application shall be made by the Owners (or
either of them), or any person on their behalf
(or on behalf of either of them) to the Town
for any kind, sort or type of permit pursuant
to which any development or construction of a
building or buildings, or structure or struc-
tures, would be permitted or allowed on the
subject lands, until such time as the subject
lands have been recorded in the Land Titles
office for the Registry Division as all or
part of a plan of subdivision registered after
the date hereof.
3. This Agreement shall run with the land and it,
and everything herein contained, shall enure
to the benefit of and be binding upon the par-
ties hereto, their heirs, executors, successors
and assigns.
IN WITNESS WHEREOF the persons comprising the Party of
the First Part have hereunto affixed their respective hands
and seals and the Party of the Second Part has hereunto
affixed its corporate seal duly attested to by the hands
of its authorized officers.
