BY-LAW 1109/80
Being a By-Law to authorize the execution
of an Agreement between the Corporation of
the Town of Pickering and Mary Edith Deans
respecting Part Lot 21, Plan 818, Pickering
(Part 2, Plan 40R-5460 ) - LD 296/79.
WHEREAS, on September 10, 1979, the Land Division
Committee of the Regional Municipality of Durham approved
the application of Nary Edith Deans for consent to sever
Lot 21, Plan 818, Pickering subject to certain terms and
conditions, one of which requires that no further applic-
ations pursuant to section 29 of The Planning Act, R.S.O.
1970, Chapter 349, be made until sanitary and storm sewers
are available; and
WHEREAS, it is deemed expedient to enter into an
Agreement with Mary Edith Deans to give effect to that
condition;
NOW THEREFORE, the Council of the Corporation of the
Town of Pickering HEREBY ENACTS AS FOLLOWS:
1. The Mayor and Clerk are hereby authorized to execute
an Agreement, in the form attached hereto as
Schedule "A", between the Corporation of the Town
of Pickering and Mary Edith Deans respecting future
applications to the Land Division Committee under
section 29 of The Planning Act, R.S.O. 1970, Chapter
349, with respect to Lot 21, Plan 818, Pickering
(LD 296/79).
BY-LAW read a first, second and third time and finally passed
this 8th day of April , 1980.

SCHEDULE "A" to By-law #1109/80
THIS AGREEMENT rade in triplicate this day of
1980
BETWEEN:
THE CORPORATION OF THE TOWN OF PICKERING
(hereinafter called the "Town"),
OF THE FIRST PART,
- and -
MARY EDITH DEANS
(hereinafter called the "Owner"),
OF THE SECOND PART
WHEREAS the owner is the owner in fee simple
certain lands and premises, being Lot 21, Plan 818, Pickering;
and
WHEREAS the Owner has made application to the Land
Division Committee of the Regional Municipality of Durham
pursuant to section 29 of The Planning Act, R.S.O. 1970,
Chapter 349, for consent to sever the said lands and
premises, which application was approved September 10, 1979,
subject to certain conditions, one of which requires that
no further such application be applied for until sanitary
and storm sewers are available;
NOW THEREFORE THIS AGREEMENT WITNESSETH, that, in
consideration of the sum of $2.00 paid by each Party to
the other, receipt of which is hereby acknowledged, the
parties hereto agree as follows:
1. The lands and premises affected by this Agreement
are those lands and premises more particularly des-
cribed as follows:
all and singular that certain parcel or tract of
land and premises situate, lying and being in the
Town of Pickering, in the Regional Municipality of
Durham and Province of Ontario, being composed of
that part of Lot 21, according to a Plan registered
in the Registry Office for the Registry Division of
Durham as Plan No. 818, designated as Part 2 on a
Plan of Reference deposited in the said office as
Plan No. 40R-5460.

2. The owner hereby agrees that she shall not make, or
authorize any other persons to make on her behalf,
after the date hereof, any application pursuant to
section 29 of The Planning Act, R.S.O. 1970, Chapter
349, as amended from time to time, or any successor
thereto, for consent to convey, mortgage or charge
any part or parts of the lands affected hereby, or
to grant, assign or exercise a power of appointment
with respect to any part or parts of the lands and
premises affected hereby or to enter into any
agreement with respect to any part or parts of the
lands and premises affected hereby, unless Municipal
sanitary and storm sewer services'are first made
available to all of the lands and premises affected
hereby.
3. This Agreement and everything contained herein shall
enure to the benefit of and be binding upon the
Parties hereto, their heirs, executors, administrators,
successors and 'assigns.
In witness whereof the Party of the first part
has hereunto affixed its corporate seal attested by the
hands of its duly authorized officers and the Party of
the second part has hereunto affixed her hand and seal.
