BY-LAW NO. 1092 /80
Being a By-Law to authorize the execution
of a release of Caspe Limited from an
Agreement between the former Township of
Pickering and Peter and Anna Dorosz
respecting Part Lot 18, Concession 1,
Pickering (including Toy Avenue).
WHEREAS, by Agreement dated May 28th, 1965 and regis-
tered in the Registry Office for the Registry Division of the
County of Ontario on January 13th, 1966 as Instrument No.
138106, the Corporation of the Township of Pickering and Peter
Dorosz and Anna Dorosz agreed to the development of certain
lands comprising part of Lot 18, Concession 1 in the former
Township of Pickering; and
WHEREAS, the Corporation of the Town of Pickering is
the successor to the Corporation of the Township of Pickering
and;
WHEREAS, Caspe Limited is the successor to Peter
Dorosz and Anna Dorosz; and
WHEREAS, the development has been completed in compli-
ance with the said Agreement to the satisfaction of the Town
of Pickering; and
WHEREAS, it is now deemed expedient to release Caspe
Limited, its successors and assigns, from the provisions of
the said Agreement;
NOW THEREFORE, the Council of the Corporation of the
Town of Pickering HEREBY ENACTS AS FOLLOWS:
1. The Mayor and Clerk are hereby authorized to execute
a release, in the form attached hereto as Schedule
"A" of Caspe Limited from an Agreement between the
former Township of Pickering and Peter and Anna
Dorosz respecting Part Lot 18, Concession 1, Pick-
ering (including Toy Avenue).
BY-LAW read a first, second and third time and finally passed
this 19th day of February , 1980.

THIS AGREEMENT made in triplicate this day of
1980.
BETWEEN:
THE CORPORATION OF THE TOWN OF PICKERING
hereinafter referred to as the "Town"
OF THE FIRST PART,
- and -
CASPE LIMITED
hereinafter referred to as the "Owner"
OF THE SECOND PART.
WHEREAS, by Agreement dated May 28th, 1965 and regis-
tered in the Registry Office for the Registry Division of
the County of Ontario on January 13th, 1966 as Instrument
No. 138106, The Corporation of the Township of Pickering
and Peter Dorosz and Anna Dorosz agreed to the development

in the Township (now Town) of Pickering; and
WHERFAS, the development has been completed in com-
pliance with the above-mentioned Agreement; and
WHEREAS, pursuant to the provisions of The Regional
Municipality of Durham Act, 1973, S.O. 1973, c.78, the
Town is the successor to The Corporation of the Township of
Pickering; and
WHEREAS, the Owner herein is the successor in title
to Peter Dorosz and Anna Dorosz;
NOW THEREFORE, THIS AGREEMENT WITNESSETH THAT, in
consideration of the mutual covenants hereinafter set
forth, the Parties hereto agree as follows:
1. The Town hereby remises, releases and forever
discharges the owner, its successors and
assigns of and from all manner of actions,
causes of action, suits, debts, dues, accounts,
bonds, covenants, contracts, claims, demands
and obligations whatsoever which the Town ever
had, now has, or which its successors and
assigns hereafter can, shall or may have for
or by reason of any cause, matter or thing
arising oz to arise by reason of the terms
and covenants contained in the Agreement,
dated May 28th, 1965 and registered in the
Registry Office for the Registry Division of
the County of Ontario on January 13th, 1966
as Instrument No. 138106, between The Corpor-

ation of the Township of Pickering and Peter
Dorosz and Anna Dorosz.
2. The Owner hereby remises, releases and forever
discharges the Town, its successors and assigns
of and from all manner of actions, causes of
action, suits, debts, dues, accounts, bonds,
covenants, contracts, claims, demands and obli-
gations whatsoever which the Owner ever had,
now has, or which its successors and assigns
hereafter can, shall or may have for or by
reason of any cause, matter or thing arising
or to arise by reason of the terms and coven-
ants contained in the said Agreement.
3. The lands affected hereby are more particularly
described as follows:
ALL AND SINGULAR that certain parcel or tract
of land and premises situate, lying and being
in the Town of Pickering, in the Regional Mun-
icipality of Durham, formerly in the Township
of Pickering, in the County of Ontario, and
.being composed of part of Lot 18, in the First
Concession of the said Township, the said par-
cel being more particularly described as fol-
lows:
PREMISING that the southerly limit of the said
Lot 18 hao a bearing of NO rth 72 dcgrc z, 5
minutes and 30 seconds East and relating all
bearings herein thereto;
COMMENCING at a point in the said Southerly
limit of Lot 18, distant easterly therealong
869.78 feet from the Southwesterly angle
thereof;
THENCE North 17 degrees 00 minutes and 30 sec-
onds West a distance of 505.50 feet to the
place of beginning of the herein described
parcel;
THENCE North

seconds East
or less to a
17 degrees 00 minutes and 30
a distance of 139.50 feet;
72 degrees 59 minutes and 30
a distance of 334.0 feet more
point;
THENCE South 17 degrees 04 minutes and 20
seconds East, a distance of 139.50 feet to
a point;
THENCE South 72 degrees, 59 minutes and 30
seconds West, a distance of 334.16 feet,
more or less, to the place of beginning.
4. This Agreement shall enure to the benefit of
and be binding upon the Parties hereto, and
their respective successors and assigns.
IN WITNESS WHEREOF, the Parties hereto have hereunder
affixed their respective Corporate Seals, duly attested by
