BY-LAW NUMBER 1399/81
Being a Restricted Area By-law to amend
Restricted Area By-law 2511, as amended,
to implement the Official Plan of the
Town of Pickering District Planning Area,
Region of Durham, in Lots 64, 65 and 66
Plan 350, in the Town of Pickering.
WHEREAS the Council of the Corporation of the Town of
Pickering deems it desirable to allow the establishment
of a day nursery on the subject lands;
AND WHEREAS an amendment to By-law 2511, as amended, is
therefore deemed necessary;
NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE TOWN OF
PICKERING HEREBY ENACTS AS FOLLOWS:
1. BY-LAW 2511
By-law 2511, passed by Council of the Corporation of
the Township (now Town) of Pickering on the 5th day
of October 1960, and approved by the Ontario Municipal
Board on the 3rd day of January 1963, and amended
from time to time, is hereby further amended only to
the extent necessary to give effect to the provisions
of this By-law.
2. TEXT AMENDMENT
Section 10 of By-law 2511, as amended, is hereby
further amended by adding thereto the following
subsection:
10.3.2 Lots 64, 65 and 66, Plan 350
(1) For the purpose of this subsection, the term
'Day Nursery, Type A' shall mean lands and
premises duly licenced pursuant to The Day
Nurseries Act, or any successor thereto, for
use as a facility for the daytime care of not
more than forty (40) children at any one time.
(2) Notwithstanding any of the provisions of this
By-law, in addition to any other uses that may
be permitted thereon, the lands designated
"R4(DN) " on Schedule "I" to By-law 1399/81 may
by used for the purpose of a Day Nursery, Type A.

3. SCHEDULE AMENDMENT
Schedule "A" to By-law 2511, as amended, is hereby
further amended by altering from "R4" to "R4(DN)"
the zone designation of the lands designated "R4(DN)"
on Schedule "I" hereto.
4. EFFECTIVE DATE
This By-law shall take effect from the day of passing
hereof, subject to the approval of the Ontario Municipal
Board, if required.
