BY-LAW NO. 1283/81
Being a By-Law to authorize the execution
of a Deed of Part Lot 28, Range 3, Broken
Front Concession, Pickering (Part 2, Plan
40R-6136) from the Corporation of the Town
of Pickering to the Minister of Transporta-
tion and Communications.
WHEREAS, the Corporation of the Town of Pickering is the owner
in fee simple of Part 2, Plan 40R-6136, being Part of Lot 28,
Range 3, Broken Front Concession, Pickering; and
WHEREAS, it is deemed desirable to transfer the said lands to
the Minister of Transportation and Communications for incorpor-
ation within the White's Road/401 Interchange;
NOW THEREFORE, the Council of the Corporation of the Town of
Pickering HEREBY ENACTS AS FOLLOWS:
1. The Mayor and Clerk are hereby authorized to execute a
Deed, in the form attached hereto as schedule "A", from
the Corporation of the Town of Pickering to the Minister
of Transportation and Communications respecting Part 2,
Plan 40R-6136, being Part of Lot 28, Range 3, Broken
Front Concession, Pickering.
BY-LAW read a first, second and third time and finally passed
this 19th day of May , 1981.

THIS INDENTURE made (in duplicate) the 19th day of May, 1981.
In pursuance of The Short Forms of Conveyances Act.
B E T W E E N:
CORPORATION OF THE TOWN OF PICKERING
hereinafter called the "Grantor"
OF THE FIRST PART,

HER MAJESTY THE QUEEN
in right of the Province of Ontario,
as represented by The Minister of
Transportation and Communications
for Ontario
hereinafter called the "Grantee"
OF THE SECOND PART.
WHEREAS, on May 9th, 1968, The Corporation of the Township of
Pickering, by the registration in the Registry Office for the
County of Durham (now the Registry Division of Durham) of Plan
128 Expropriation, expropriated for municipal purposes the fee
simple in certain parts of Lot 28 and 29, Range 3, Broken
Front Concession, Pickering, including the lands hereinafter
described; and
WHEREAS, The Corporation of the Town of Pickering is the suc-
cessor to The Corporation of the Township of Pickering, pur-
suant to the provisions of The Regional Municipality of Durham
Act, 1973, S.O. 1973, chapter 78, as amended; and
WHEREAS, the lands hereinafter described are no longer required
for municipal purposes;
WITNESSETH that in consideration of the sum of Two Dollars
($2.00) of lawful money of Canada, now paid by the said Grantee
to the said Grantor, the receipt whereof is hereby by it
acknowledged, the said Grantor DOTH GRANT unto said Grantee in
fee simple.
ALL AND SINGULAR that certain parcel or tract of land and prem-
ises situate, lying and being in the Town of Pickering in the
Regional Municipality of Durham and Province of Ontario and
being composed of that part of Lot 28, Range 3, Broken Front
Concession, designated as Part 2 on a Reference Plan deposited
in the Registry Office for the Registry Division of Durham (NO.
40) as Plan 40R-6136.
TO HAVE AND TO HOLD unto the said Grantee her heirs, executors,
administrators, successors and assigns to and for her and their
sole and only use forever.

SUBJECT NEVERTHELESS to the reservations, limitations, provisos
and conditions expressed in the original grant thereof from the
Crown.
THE said Grantor COVENANTS with the said Grantee THAT it has
the right to convey the said lands to the said Grantee notwith-
standing any act of the said Grantor.
AND that the said Grantee shall have quiet possession of the
said lands, free from all encumbrances.
AND the said Grantor COVENANTS with the said Grantee that it
will execute such further assurances of the said lands as may
be requisite.
AND the said Grantor COVENANTS with the said Grantee that it
has done no act to encumber the said lands.
AND the said Grantor RELEASES to the said Grantee ALL its claims
upon the said lands.
IN WITNESS WHEREOF, the Grantor herein has hereunto set its
corporate seal duly attested by its proper authorized officers.

Being a By-Law to authorize the execution
of a Deed of Part Lot 28, Range 3, Broken
Front Concession, Pickering (Part 2, Plan
