Restricted Area By-law 3037, as amended,
to Implement the Offtctal Plan of the
Town of Picketing Dtstrtct Planntng Area,
Regton of Durham, wtthtn the boundaries
of the Town of Picketing...
WHEREAS the Counctl of the Corporation of the Town of
Picketing deems tt destrnble to amend the permitted uses,
zontng requirements, definitions, general provisions of
the Rural Agricultural Zone "A";
AND #HEREAS an amendment to By-law 3037, as amended, ts
therefore deemed necessary;
NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE TOgN
OF P]CKER[NG HEREBY ENACTS AS FOLLOgS:
SECT]ON 2 - DEFINITIONS, of By-law 3037, as amended,
is hereby further amended as follows:
(1) By addtng thereto the following:
2.7.1 BU]LDZNG
"Building" shall mean a structure occupying
an area greater than 9.5 square metres
consisting of a wall, roof and floor, or
any one or more of them, or a structural
system servtng the functton thereof,
Including all the works, ftxtures and
servtce systems appurtenant thereto.

DHELL]NG, ACCESSORY OR ACCESSORY O~ELLING
"Dwelling, Accessory" shall mean a
detached dwelltng whtch ts accessory
to a permitted non-residential use

where such dwe111ng ts located.

"Dwelling, Stngle" shall mean a dwelltng

2.21 DWELLZNG UNIT
"Dwelling Untt" shall mean one or more
habitable rooms occupied or capabTe of
betng occupted as a single,Independent
and separate housekeeping unit containing
a separate kitchen and sanitary facilities.

2,22 DWELLING UNIT AREA
"Owelllng Unit Area' shall mean the
aggregate of the floor areas of all
habitable rooms of a dwelltng untt.
2.28 FLOOR AREA
· Floor Area" shall mean the area of
the floor surface contained within the
outside walls of a storey or part of a
storey.
2.32.1 GROSS FLOOR AREA
'Gross Floor Area" shall mean the
aggregate of the floor areas of all the
storeys of a butldtng or structure, or
a part thereof as the case may be, other
than a prtvate garage, an atttc or a
cellar.
SECTION 5 ~ GENERAL PROVISIONS TO ALL ZONES, of By-law
3037, as amended, is hereby further amended as follows:
(1) By revoktng Clause 1 of Subsection 5.19 in its
entirety and substituting therefor the following:
5.19.1 MINIMUM OFF STREET PARKING REQUIREMENTS

except the case of detached, semi-detached, and
accessory dwellings.

5.27 TRUCK, BUS AND COACH BODIES

No truck, bus, coach or streetcar body,
or structure of any kind, other than a
dwelling unit or an accessory dwelling unit,
erected and used in accordance with this and
all other By-laws of the Town, shall be used
as a dwelling unit within the area affected
by this By-law, whether or not the same is
mounted on wheels°
TRAILER PARKS AND PRIVATE RECREATIONAL USES
The establishment of trailer parks, mobile
home parks, private clubs, commercial clubs,
camping establishments or private recreational
parks shall be prohibited within the area
covered by this By-law, save and except where
such are specifically permitted.
SERVICES
No dwelling unit shall be permitted on any
lot within the area affected by this By-law,
unless such a lot is served either by a
public water system and a sanitary sewer
system or by a private water and effluent
disposal system that has been approved by
the Region of Durham Health Unit.

SECTION 6 - "RURAL AGRICULTURAL ZONE'AN, of By-law 3037.
as amended, ts hereby further amended by revOking
Subsections 6.1, 6.2, and 6.3 tn their entirety and
substituting therefor the following:
6.1 USES PER#]TTED
6.1.1 Resident1&1:
A detached dwelling, subject to
the provisions of Sectlon 6.2.i
6.1.1.1 Home Occupation:
The offtce of a phystct)n, denttst or drugless
practitioner located tn the detached
dwe111ng used by such physician, denttst or
drugless practitioner es his prtvate residence.
Such offtce to be used for consultation and
emergency treatment only, but shall not be tn
the nature of a c11ntc or prtvate hospital,
and further such offtces shall not occupy tn
excess of t#enty-ftve (25) percent of the total
floor area of such detached d~elllng.
6.1.2 Aqrtcultural:
Agricultural uses Including forestry and
reforestation, conservation uses and uses
connected with the conservation of w~ld ltfe,
field crops, truck gardening, greenhouses,
orchards, aviaries, aptertel end mushroom
farms, farms for graztng, breeding, ratstng
or tratntng of horses or cattle, or other
stmtlsr uses or enterprises customarily
carried on tn the fteld of general agriculture
Including one detached dwelling erected and
used by the bona-f~de agricultural user~ but
not Including uses obnoxious to the publlc
welfare. Facilities for the ratstng of fur-
beartng antmals, kennels and swt11 fed ptgs
shall not be permitted.
6.1.2.1 Accessory Agricultural Residential:
Notwithstanding the provisions of Sectton
6.2.2 hereof, a bona-fide agricultural user
may be permitted to establish an accessory
dwe111ng for the uses p~'mttted under
Sectton 6.1.2, only tn accordance ~tth the
provisions of Sectton 6.2.3.

Recreational:
All uses permitted in Sectton 5.16 subject to
the requirements thereof and tn accordance
~tth the provisions of Section 6.2.4.

6.1.4 Other Uses:
6.1.4.1 ~nstttuttonal:
Churches, publlc and prtvate schools,
educational and religious Institutions,
research laboratories under the
Jurisdiction of a university or government
authority;
(b)
Publlc and prtvat~ hospitals, sanitaria
and clinics as deftned by the P~tvate
Hospttals'Act, the Prtvate Sanitaria Act,
and the Pbbllc Hospitals Act;
(c) All such Institutional uses shall be
governed by the provisions of Sectton 6.15.
6.1.4.2 Business:
(a) Stables, rtdtng academies, antmal hospitals
and veterinary establishments and the sale
by a farmer of hts produce;
(b) All such bustness uses shall be governed
by the provisions of Sectton 6.2.5.

tn a Rural Agricultural Zone, provtded that such
lot was under separate ownership on the 25th day
of November 1963 and the owner of such
lot does not own any abutttng land and provtded
further that the following requirements are

4. EFFECTIVE DATE
This By-law shall take effect from the day of
passing hereof, subject to the approval of the
Ontario Municipal Board, if required.
