BY-LAW NUMBER 1505/82
Being a Restricted Area By-law to amend
Restricted Area By-law 3037, as amended,
to implement the Official Plan of the
Town of Picketing District Planning Area,
Region of Durham, in Part of Lot 13,
Plan 12, (Claremont), in the Town of
Pickering.
WHEREAS the Council of the Corporation of the Town of Pickering
deems it desirable to allow the establishment of a day nursery
on the subject lands;
AND WHEREAS an amendment to By-law 3037, as amended, is
therefore deemed necessary;
NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE TOWN OF
PICKERING HEREBY ENACTS AS FOLLOWS:
1. BY-LAW 3037
By-law 3037, passed by Council of the Corporation of the
Township (now Town) of Pickering on the 3rd day of August
1965, and approved by the Ontario Municipal Board on the
lOth day of November 1966, and amended from time to ti~e~
is hereby further amended only to the extent necessary to
give effect to the provisions of this By-law.
2. TEXT AMENDMENT
Section 8 of By-law 3037, as amended, is hereby further
amended by adding thereto the following subsection:
8.3.1 Part Lot 13, Plan 12
(1)
For the purpose of this subsection, the term
'Day Nursery, Type A' shall mean "lands and
premises duly licenced pursuant to The Day
Nurseries Act, or any successor thereto, for
use as a facility for the daytime care of not
more than forty (40) children at any one time."

Notwithstanding any of the provisions of this
By-law, in addition to any other uses that may
be permitted thereon, the lands designated "R5(DN)"
on Schedule "I" to By-law 1505/82 may be used for
the purpose of a Day Nursery, Type A.
3. SCHEDULE AMENDMENT
Schedule "A" to By-law 3037, as amended, is hereby
further amended by altering from "RS" to "R5(DN)"
the zone designation of the lands.designated "R5(DN)"
on ~chedule "I" hereto.

4. EFFECTIVE DATE
This By-law shall take effect from the day of passing
hereof, subject to the approval of the Ontario
Municipal Board, if required.
