BY-LAW NO. 144~82
Being a By-Law to authorize the execution
of a Deed between the Corporation of the
Town of Pickering and Wayne Douglas Smith
and Sharon Emily Smith respecting part of
Lot 30, Concession 1, being part of Part
2, Plan 82 Miscellaneous (558 Sheppard
Avenue)
WHEREAS pursuant to the provisions of section 193 of the Municipal Act,
R. SoO. 1980, chapter 335, the council of every corporation may sell
any land when no longer required for the purposes of the corporation;
and
WHEREAS on November 16th, 1966, the Corporation of the Township of
Pickering acquired, by Instrument No. 147860, certain lands in Lot
30, Concession 1, being part of Part 2, Plan 82, Miscellaneous for
road widening purposes; and
WHEREAS such lands were never dedicated as public highway, and are
now no longer required for road purposes; and
WHEREAS pursuant to the provisions of the Regional Municipality of
Durham Act, R.S.O. 1980, chapter 434, the Corporation of the Town of
Pickering is the successor to the Corporation of the Township of
Pickering;
NOW THEREFORE, the Council of the Corporation of the Tow~ of Pickering
HEREBY ENACTS AS FOLLOWS:
The Mayor and Clerk are hereby authorized to execute a Deed, in
the form attached hereto as Schedule "A", between the Corporation
of the Town of Pickering and Wayne Douglas Smith and Sharon Emily
Smith respecting a conveyance of part Lot 30, Concession 1, being
part of Part 2, Plan 82 Miscellaneous, more particularly described
in Schedule "A".
The consideration for the conveyance of the lands referred to in
section 1 shall be a return conveyance from Wayne Douglas Smith
and Sharon Emily Smith to the Corporation of the Town of Pickering
of a storm water easement over the easterly 4.57 metres of the
said lands and of Part 57, Plan 40R-4433.
BY-LAW read a first, second and third time and finally passed this
1st day of March , 1982.

THIS INDENTURE made in duplicate the 1st day of March, 1982.
IN PURSUANCE OF THE SHORT FORMS OF CONVEYANCES ACT
BETWEEN :
THE CORPORATION OF THE TOWN OF PICKERING
hereinafter called the "Grantor"
OF THE FIRST PART,
- and -
WAYNE DOUGLAS SMITH
and
SHARON EMILY SMITH
of the Town of Pickering, in the
Regional Municipality of Durham
hereinafter called the "Grantees"
OF THE SECOND PART.
WHEREAS, pursuant to the provisions of the Regional Municipality of
Durham Act, now R.S.O. 1980, chapter 434, the Grantor herein is the
successor to The Corporation of the Township of Pickering which is the
registered owner, in fee simple, of the lands hereinafter described;
WITNESSETH that in consideration of the sum of ($2.00) Two Dollars of
lawful money of Canada, now paid by the said Grantees to the said
Grantor, the receipt whereof is hereby by it acknowledged, the said
Grantor DOTH GRANT unto said Grantees in fee simple.
ALL AND SINGULAR that certain parcel or tract of land and premises
situate, lying and being in the Town of Pickering, in the Regional
Municipality of Durham and Province of Ontario and being composed of
part of Lot 30, Concession 1, more particularly shown as part of Part 2
according to a plan filed in the Land Registry Office for the Registry
Division of Durham as Plan 82 Miscellaneous, the boundaries of which
are described as follows:
PREMISING that the southerly limit of said Part 2 has a bearing of N73
degrees 05'30"E, all bearings herein are referred thereto;
COMMENCING at a point in the
50.00 feet measured easterly

southerly limit of said Part 2 distant
thereon from the southwest angle of the
THENCE N73 degrees 05'30"E, along the southerly limit of Part 2, 104.42
feet;

THENCE N16 degrees 54'30"W, 10.00 feet;
THENCE S73 degrees 05'30"W, parallel to the southerly limit of the said
Part 2 distant 10.00 feet northerly therefrom, 104.42 feet;
THENCE S16 degrees 54'30"E, 10.00 feet to the Point of Commencement.
AS DESCRIBED in Instrument No. 147860.
TO HAVE AND TO HOLD unto the said Grantees, their heirs and assigns to
and for them and their sole and only use forever.
SUBJECT NEVERTHELESS to the reservations, limitations, provisos and
conditions expressed in the original grant thereof from the Crown.
THE said Grantor COVENANTS with the said Grantees THAT it has the right
to convey the said lands to the said Grantees notwithstanding any act
of the said Grantor.
AND that the said Grantees shall have quiet possession of the said
lands, free from all incumbrances.
AND the said Grantor COVENANTS with the said Grantees that it will
execute such further assurances of the said lands as may be requisite.
AND the said Grantor COVENANTS with the said Grantees that it has done
no act to incumber the said lands.
AND the said Grantor RELEASES to the said Grantees ALL its claims upon
the said lands.
IN WITNESS WHEREOF the Grantor has affixed its corporate seal, duly
attested by the hands of its duly authorized officers.
