HomeMy WebLinkAboutBy-law 1817/84THE CORPORATION OF THE TOWN OF PICKERING BY-LAW NO. 1817 /84 Being a by-law to authorize the execution of an Agreement between the Corporation of the Town of Picketing and Karsten Hans Smith respecting the future development of that part of Lots 61, 62 and 63, Plan 43, Village of Claremont designated as Part 4, Plan 40R-7416 (LD 303/82) WHEREAS by decision dated November 22, 1982, the Regional Municipality of Durham Land Division Committee granted its consent to the creation of a parcel of land subject to several conditions, one of which requires that any further development will be by a plan of subdivision on/y; NOW THEREFORE, the Council of the Corporation of the Town of Pickering ttEREBY ENACTS AS FOLLOWS: The Mayor and Clerk are hereby authorized to execute an Agreement, in the form attached hereto as Schedule A, between the Corporation of the Town of Picketing and Karsten Hans Smith respecting the future development of that part of Lots 61, 62 and 63, Plan 43, Village of Claremont designated as Part 4, Plan 40R-7416 (LD 303/82). BY-LAW read a first, second and third time and finally passed this 16th day of April , 1984. Clerk To B~-law 1817/84 THIS AGREEMENT made in duplicate as of the 10th day of February, 1983. BETWEEN: KARSTEN HANS SMITH hereinafter called the "Owner" OF THE FIRST PART, THE CORPORATION OF THE TOWN OF PICKERING hereinafter called the "Town" OF THE SECOND PART. WHEREAS by decision dated November 22, 1982, (LD 303/82), the Regional Municipal- ity of Durham Land Division Committee granted its consent to the creation of a parcel of land subject to several conditions, one of which requires that any further develop- ment will be by a plan of subdivision only; NOW THEREFORE, in consideration of the sum of $2.00 now paid by each party to the other, receipt of which by each is hereby acknowledged, the Owner and the Town agree as follows: The lands affected hereby, hereinafter called the ULands", are more particularly described as follows: ALL AND SINGULAR that certain parcel or tract of land and premises situate, lying and being in the Town of Picketing, in the Regional Munic- ipality of Durham and Province of Ontario and being composed of that part of Lots 61, 62 and 63, Plan No. 43, Village of Claremont, designated as Part 4, Plan 40R-7416. The Owner shall not development the lands, for any purpose, or in any manner, except pursuant to a plan of subdivision proposed, processed and approved pursuant to the provisions of the Planning Act, R.S.O. 1970, chapter 379, as amended, or any successor thereto. This Agreement and everything herein contained shall enure to the benefit of and be binding upon the Parties hereto, their heirs, executors, administrators, successors and assigns. IN WITNESS WHEREOF, the Party of the first part has hereunto affixed his hand and seal and the Party of the second part has hereunto affixed its corporate seal, attested to by the hands of its proper officers in that behalf, fully authorized. SIGNED, SEALED & DELIVERED In the presence of witness KARSTEN HANS SMITH THE CORPORATION OF THE TOWN OF PICKERING Mayor Clerk I Smith, spouse of Karsten Hans Smith, the Owner, herein, hereby consent to the execution and entering into of this Agreement by Karsten Hans Smith and to the registration of this Agreement upon the title to the Lands affected hereby and agree to be bound by the terms of the said Agreement.
