Recommendation:
A by-law should be enacted authorizing the execution of a Transfer of Easement for
stormwater purposes from Christopher and Adriana Benedetto to the City over that part
of Lot 4, Registrar's Compiled Plan 1041, Pickering, designated as Part 8, Plan
40R-21388.

Background: In approving Land Severance Application LD 66/02, the
Durham Land Division Committee imposed several conditions, one of which requires
that the Owner satisfy the City with respect to the conveyance of a stormwater
easement.
The Owner has prepared and registered the applicable reference plan outlining the
location of the easement and is in a position to convey the interest to the City.
Enactment of the attached by-law will authorize the execution and registration of
required Transfer of Easement.

THE CORPORATION OF THE CITY OF PICKERING
BY-LAW NO. "083/03
Being a by-law to authorize the execution of
a Transfer of Easement for stormwater
purposes from the Owner of that part of lot
4, Registrar's Compiled Plan 1041, Pickering,
designated as Part 8, Plan 40R-21388.
WHEREAS, pursuant to land Division Committee Application lD 66/02, the Owner is
required to grant an easement in favour of the City over that part of lot 4, Registrar's
Compiled Plan 1041, Pickering, designated as Part 8, Plan 40R-21388.
WHEREAS, pursuant to the provisions of the Municipal Act, R.S.O. 1990, chapter MA5,
the Council of the City may pass by-laws for acquiring or disposing of interests in lands;
NOW THEREFORE, the Council of The Corporation of the City of Pickering HEREBY
ENACTS AS FOllOWS:
1.
The Mayor and Clerk are hereby authorized to execute a Transfer of Easement,
in a form satisfactory to the Solicitor for the City over that part of lot 4,
Registrar's Compiled Plan 1041, Pickering, designated as Part 8, Plan
40R-21388.
BY-lAW read a first, second and third time and finally passed this 20th day of January,
