That Council move into closed session in accordance with the Municipal Act and the
Procedure By-law to receive advice that is subject to solicitor-client privilege and to discuss
personal matters about an identifiable individual. The matter being considered in closed
session pertains to a confidential presentation from the Director, Human Resources and
John Mascarin, Partner, and Meghan Cowan, Partner, Aird & Berlis LLP, regarding
Harassment Investigation Findings and Recommendations, HUR 070 – Respect in the
Workplace Policy.

Confidential Special Council - Public Report
Mayor Ashe stated that during the closed portion of the meeting, Council considered a
matter pertaining to a confidential presentation from the Director, Human Resources and
John Mascarin, Partner, and Meghan Cowan, Partner, Aird & Berlis LLP, regarding
Harassment Investigation Findings and Recommendations HUR 070 – Respect in the
Workplace Policy. The matter was discussed in closed session to receive advice subject to
solicitor-client privilege as it pertains to personal matters about an identifiable individual.

Confidential Presentation from the Director, Human Resources and John
Mascarin, Partner and Meghan Cowan, Partner, Aird & Berlis LLP Re:
Harassment Investigation Findings and Recommendations HUR 070 –
Respect in the Workplace Policy
Councillor Robinson expressed concerns regarding the process undertaken
pertaining to the harassment investigation and findings, particularly that the full
report had not been disclosed and that she was unable to ask questions to the third-
party investigator. She further expressed concerns regarding the remedies and
restrictions imposed on her because of the findings of the investigation.
Mayor Ashe called Councillor Robinson to order and cautioned her on disclosing
matters that were discussed in closed session.
Mayor Ashe stated that the City, as an employer, was legally compelled to
investigate complaints pertaining to harassment, noting that the complaints were not
just from one member of the City’s Senior Staff, but four who felt harassed and
threatened by the Councillor’s actions.

That Council hereby proclaims their support for the administrative restrictions,
as contained in Recommendation 1 of the Confidential PowerPoint
presentation document presented by the Director, Human Resources and Aird
& Berlis LLP, at the June 8th Special Council Meeting, that have been
previously implemented under the direction of the City’s Chief Administrative
Officer (CAO);
1.
That Recommendations 2 and 3 as contained in the Confidential PowerPoint
presentation document be approved and endorsed;
2.
That the Clerk be directed to append the Confidential PowerPoint presentation
and enter the exact recommendations approved by Council into the
confidential meeting minutes; and,
3.
That the Mayor be authorized to issue a public statement and that the
statement may include the adopted recommendations.
