BY-LAW NUMBER 2028/85
Being a By-law to amend Restricted Area (Zoning)
By-law 3037, as amended, to implement the
Official Plan of the Town of Picketing District
Planning Area, Region of Durham, in Part Lot 34,
Concession 5 (Part 1, Plan 40R-8549) in the Town
of Picketing. (A 4/85)
WHEREAS the Council of the Corporation of the Town of Picketing
deems it desirable to recognize the siting of the existing
dwelling and the lot frontage and lot area of the existing lot;
AND WHEREAS an amendment to By-law 3037, as amended, is therefore
deemed necessary;
NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE TOWN OF
PICKERING HEREBY ENACTS AS FOLLOWS:
1. BY-LAW 3037
By-law 3037, passed by the Council of the Corporation of the
Township (now Town) of Pickering on the 3rd day of August
1965, and approved by the Ontario Municipal Board on the
lOth day of November 1966, and amended from time to time, is
hereby further amended only to the extent necessary to give
effect to the provisions of Sections 2 and 3 hereof.
SCHEDULE "A" AMENDMENT
Schedule "A" to By-law 3037, as amended, is hereby further
amended by changing from 'A' (Rural Agricultural Zone) to
'V' (Village Zone) the zone designation of lands designated
'V' on Schedule 'I' attached hereto being Part Lot 34,
Concession 5 (Part 1, Plan 40R-8549).
TEXT AMENDMENT
Section 7 of By-law 3037, as amended, is hereby further
amended by adding thereto the following subsection:
7.3.1 Part Lot 34, Concession 5 (Part 1, Plan 40R-8549)
(1)
Despite the provisions of section 7.2.1, the
minimum front yard and the minimum south side
yard for a residential one-family detached
dwelling located on that part of Lot 34,
Concession 5, designated as Part 1, Plan 40R-8549
shall be 1.64 metres and 2.26 metres respectively.
(2) Subsection (1), above, shall not apply where the
residential one-family detached dwelling or any
part or extension thereof is constructed after
January 9th, ~985.

This By-law shall take
