HomeMy WebLinkAboutBy-law 1991/85THE CORPORATION OF THE TOWN OF PICKERING BY-LAW NO. 1991 /85 Being a by-law to authorize the execution of releases of servicing/development/site plan Agree- ments between Torwest Properties Limited or Bramalea Limited and The Corporation of the Town of Picketing respecting part Lot 19, Range 3, B.F.C., Picketing (Part 4, Plan 40R-2384) (draft plan 18T-83013) WHEREAS, pursuant to various provisions of the Planning Act, R.S.O. 1980, chapter 379, The Corporation of the Town of Picketing entered into various agreements be- tween 1975 and 1981 with Torwest Properties Limited or Bramalea Limited respecting the servicing/development/site planning of that part of Lot 19, Range 3, B.F.G., Pickering, designated as Part 4, Plan 40R-2384; and WHEREAS, those lands are now being developed pursuant to a plan of subdivision and a corollary subdivision agreement rendering the previous agreement obsolete and redundant; NOW THEREFORE, the Council of The Corporation of the Town of Pickering HEREBY ENACTS AS FOLLOWS: The Mayor and Clerk are hereby authorized to execute a release, in the form attached hereto, of each of the following agreements: (a) Site Plan Agreement dated July 29th, 1975, registered August 27th, 1975 as Instrument No. D13812, between Torwest Properties Limited and The Corporation of the Town of Pickeringl (b) Development Agreement dated August 8th, 1978, registered September 8th, 1978 as Instrument No. D76417, between Torwest Properties Limited, The Corporation of the Town of Picketing and Harvey Hubbell of Canada Limited; (c> Agreement dated March 2nd, 1981, registered May 28th, 1981 as Instru- ment No. D123259, between Bramalea Limited, The Corporation of the Town of Pickering and The Royal Bank of Canada; (d) Agreement dated March 2nd, 1981, registered May 28th, 1981 as Instru- ment No. D123260, between Bramalea Limited, The Corporation of the Town of Picketing and The Royal Bank of Canada; and (e) Agreement dated March 2nd, 198l, registered May 28th, 1981 as Instru- ment No. D123261, between Bramalea Limited, The Corporation of the Town of Pickering and The Royal Bank of Canada. BY-LAW read March, 1985. a first, second and third time and finally passed this 18th day of ~.ayor Clerk pr°[~te~ SCHEDULE A RELEASE & DISCHARGE WHEREAS, by Agreement dated , registered on in the Land Registry Office for the Registry Division of Durham (No. ment No. , between 40) as Instru- hereinafter referred to as the "Owner", and THE CORPORATION OF THE TOWN OF PICKERING hereinafter referred to as the "Town", the Owner made certain covenants and agreements with the Town relating to the development of the lands described in Schedule A hereto, NOW THEREFORE, in consideration of the payment of the sum of $2.00, by or on behalf of the Owner to the Town, receipt of which is by the Town hereby acknowl- edged, the Town hereby remises, releases and forever discharges the Owner and its successors and assigns, from any and all liabilities, actions, causes of action, debts, claims or demands of any kind which the Owner may have been, is or may otherwise become subject to pursuant to the provisions of the said Agreement.
