BY-LAW NUMBER 1983/85
For restricting and regulating the operation
of off-road vehicles in the Town of Pickering.
Whereas pursuant to section 14.1 of the Off-Road Vehicles Act, S.O. 1983, c. 53,
municipalities may pass by-laws to regulate, govern or prohibit the operation of
off-road vehicles;
Now Therefore the Council of the Corporation of the Town of Pickering hereby enacts as
follows:
1. In this by-law:
a) "occupier" includes;
(i) a person who is in physical possession of the land, or
(ii) a person who has responsibility for and control over the condition of
land or the activities there carried on, or control over persons
allowed to enter the land,
notwithstanding that there is more than one occupier of the same land;
b)
"off-road vehicle" means a vehicle propelled or driven otherwise than by
muscular power or wind and designed to travel,
(i) on not more than three wheels, or
(ii) on more than three wheels and being of a prescribed class of vehicle;

No person shall operate an off-road vehicle without authority from the occupier
of the property.
No person shall operate an off-road vehicle in the Town of Pickering south of
the Ontario Hydro right-of-way (Gatineau Line).
The provisions of this by-law shall not apply to the operation of off-road
vehicles in the following circumstances:
a)
When an off-road vehicle is being operated in an organized meet, rally or
race which is held under the authority and permission of a resolution of
the Council of the Town of Pickering.
b)
When such off-road vehicle is being operated in a parade that is held under
the authority of a parade permit of the Town of Pickering.
c)
When such off-road vehicle is actually engaged in works undertaken by or on
behalf of the Town of Pickering or other public authority.
Every person who contravenes any of the provisions of this by-law is guilty of
an offence and upon conviction thereof, is liable to a fine of not more than
$2,000.00, exclusive of costs.
The driver of an off-road vehicle, not being the owner, is liable to any penalty
provided under this by-law, and the owner of the off-road vehicle is also liable
to such penalty unless at the time the offence is committeed, the off-road
vehicle was in the possession of a person other than the owner without the
owner's consent.
By-law read a first, second and third time and finally passed this llthday of March,
