BY-LAW NO. 1968/85
Being a by-law to authorize the execution of a
Deed between The Corporation of the Town of
Picketing and Jerry Lepka respecting part Lot 5,
Plan 283, Picketing (Part 2, PLan 40R-2238).
WHEREAS, by Instrument No. D4843, dated April 5th, 1975 and registered April llth,
1975, The Corporation of the Town of Pickering acquired, inter alia, that part of Lot
5, Plan 283, Pickering designated as Part 2, Plan 40R-2238, for future road widening
purposes; and
WHEREAS, as a result of the adoption of the Fairport Community - Rosebank Neigh-
bourhood - Development Plan, it is apparent that the future needs of the area will
not require the use of the subject lands as a road widening; and
WHEREAS, pursuant to the provisions of the Municipal Act, R.S.O. 1980, chapter
302, section 193(I), the council of every corporation may sell any ]and required for
the purposes of the corporation when no longer so required;
NOW THEREFORE, the Council of the Corporation of the Town of Picketing HEREBY
ENACTS AS FOLLOWS:
The Mayor and Clerk are hereby authorized to execute a Deed in the form
attached hereto as Schedule A between The Corporation of the Town of Picker-
lng and Jerry Lepka respecting the conveyance to those persons of that part of
Lot 5, Plan 283, Picketing, designated as Part 2, Plan 40R-2238 (Rosebank
Road South.
BY-LAW read a first, second and third time and finally passed this 4th day of Febru-
ary, 1985.
SCHEDULE A
THIS INDENTURE dated February 4th, 1985.
BETWEEN :
THE CORPORATION OF THE TOWN OF PICKERING
hereinafter called the "Grantor"
OF THE FIRST PART,
- and -
JERRY LEPKA
hereinafter called the "Grantee"
OF THE SECOND PART,
WITNESSETH that in consideration of the sum of Two Dollars of lawful money of
Canada, now paid by the Grantee to the Grantor, the receipt whereof is hereby by it
acknowledged, the Grantor does grant unto the Grantee in fee simple as joint tenants
and not as tenants in common,
ALL AND SINGULAR that certain parcel or tract of land and premises situate, lying
and being the the Town of Picketing, in the Regional Municipality of Durham and
Province of Ontario, being composed of that part of Lot 5, according to a Plan filed
in the Land Registry Office for the Registry Division of Durham (No. 40) as Plan
283, designated as Part 2 on a plan of survey or record deposited in the said Office
as Plan 40R-2238.
TO HAVE AND TO HOLD unto the Grantee, their heirs and assigns to and for them
and their sole and only use forever.
SUBJECT nevertheless to the reservations, limitations, provisos and conditions ex-
pressed in the original grant thereof from the Crown.
The Grantor covenants with the Grantee that it has the right to convey the lands to
the Grantee notwithstanding any act of the Grantor.
AND that the Grantee shall have quiet possession of the lands, free from all encum-
brances.
AND the Grantor covenants with the Grantee that it will execute such further assur-
ances of the lands as may be requisite.
AND the Grantor covenants with the Grantee that it has done no act to encumber the
lands.
AND the Grantor releases to the Grantee all its claims upon the lands.
IN WITNESS WHEREOF the Grantor has hereunto affixed its corporate seal duly
attested by its proper authorized officers.
