That, to advance the prescribed provincial priorities of building 1.5 million new residential units by December 31, 2031, and constructing and maintaining infrastructure to support housing, Pickering Council requests that the Minister of Municipal Affairs and Housing modify Map 1. Adjournment Memo To: Mayor Ashe January 26, 2024 Members of Council From: Catherine Rose Chief Planner Copy: Chief Administrative Officer Director, City Development Director, Corporate Services & City Solicitor Director, Economic Development & Strategic Projects City Clerk Subject: Request to the Minister of Municipal Affairs and Housing to change the designation of certain lands in the Durham Regional Official Plan -Mayoral Direction 02-2024 File: A-2100-020 This memo responds to Mayoral Direction 02-2024. The purpose of this memo is to present to Council, for their consideration, a resolution requesting that the Minister of Municipal Affairs and Housing (the “Minister) modify the designation of approximately 15 hectares of land in Seaton, from Employment Areas to Community Areas, prior to approving the Durham Regional Official Plan. In the Mayor’s opinion, the change will advance the prescribed provincial priorities of building 1.5 million new residential units by December 31, 2031, and constructing and maintaining infrastructure to support housing. Requested Redesignation of Certain Employment Lands in Seaton Seaton TFPM Inc. owns most of the lands in the Thompson’s Corners Neighborhood of Seaton. A map showing their land holdings is attached (see Seaton TFPM Inc. Land Holdings Map, Attachment 1). Plan of Subdivision SP-2015-03(R) was draft approved for these lands on November 3, 2022. In accordance with the Durham Regional Official Plan (DROP), and the Pickering Official Plan (City’s OP), the lands are proposed to be developed for both Community Area uses (residential/mixed uses and ancillary purposes), as well as for Employment Area uses (see Employment and Community Areas Map, Attachment 2). Over much of last year, the landowner has had numerous discussions with City staff, from City Development and Economic Development & Strategic Projects, exploring the potential to redesignate some of the blocks of land from Employment Areas to a designation that permits residential/mixed uses and ancillary purposes. The blocks under discussion for redesignation are identified on Attachment 2. - 1 - January 26, 2024 Page 2 of 3 Request to the Minister of Municipal Affairs and Housing In reviewing the request, City staff observe that these blocks are relatively small (2-4 hectares), fragmented by roads and the natural heritage system, and adjacent to planned residential. It is the opinion of the Director, Economic Development & Strategic Projects that these parcels will be difficult to market for employment uses. In principle, both the Director, Economic Development & Strategic Projects and I can support the designation of these blocks of land being changed from Employment Areas to Community Areas. Additionally, the support is subject to the landowners submitting appropriate official plan amendment and rezoning applications for Council’s consideration, to accommodate neighbourhood uses, such as additional residential, commercial uses, and supportive uses including a place of worship. The relatively small loss of employment lands, and related jobs, can be made up elsewhere in the City. The Durham Regional Official Plan Must Be Amended First For such a change to occur, the Employment Areas designation must be amended in all applicable plans and zoning by-laws. As Council is aware, a lower tier official plan must conform with an upper tier plan, and an upper tier plan must conform with Provincial Plans. Regional Council, in adopting its new Official Plan on May 17, 2023, replicated designations from the Central Pickering Development Plan (CPDP), notwithstanding the CPDP was revoked by the Province on December 14, 2022. Seaton TFPM Inc. cannot apply for amendments to the City’s OP without an amendment to the DROP. Why should Council Act Now? Last week, Mayor Ashe became aware that the Durham Regional Official Plan, 2023, as adopted by Regional Council, is before the Minister of Municipal Affairs and Housing for approval. There is a small window of time now to request a modification to the DROP, prior to the Minister’s approval. Council has an opportunity to request that the Minister modify the designation in the DROP underlying the five blocks of land in the Seaton TFPM Inc. Draft Plan of Subdivision SP-2015-03(R), from Employment Areas to Community Areas. In the absence of the Minister modifying the Plan now, an amendment to convert Employment Areas lands to Community Areas would have to wait several years until the Region of Durham completes its next Comprehensive Official Plan Review. Accordingly, it is recommended that Council approve the following resolutions: 1. That, to advance the prescribed provincial priorities of building 1.5 million newresidential units by December 31, 2031, and constructing and maintaininginfrastructure to support housing, Pickering Council requests that the Minister of Municipal Affairs and Housing modify Map 1. Summary In my opinion, the request to change the designation of the lands represents good planning, providing opportunities for compatible uses, being additional residential, mixed uses, commercial and other uses which help create complete communities. The small sized parcels, currently identified for employment, would be challenging to market for such purposes, and can more readily be developed for community uses. The employment lands and jobs can be recaptured elsewhere in the City. Should Council support this request, and the Minister concur, Council will have approval over the future applications for amendments to the City’s OP and zoning by-law that will be required by Seaton TFPM Inc.
