Being a by-law to authorize the construction
of a storm sewer in the Brock East Community
Whereas pursuant to section 218.2 of the Municipal Act, R.S.O. 1980, c. 302, as
amended, the counciol of a local municipality, in authorizing the construction of
sewage works, may by by-law provide for imposing upon owners or occupants of land
who derive or will or may derive a benefit from the sewage works a rate sufficient
to pay for the whole or such portion or percentage of the capital cost of the works
as the by-law may specify;
Now Therefore the Council of the Corporation of the Town of Pickering hereby enacts
as follows:
The land for which the owners or occupants are made liable for the sewer rate
imposed is defined in Schedule "A" attached hereto.

That a storm sewer and appurtenances be constructed in accordance with
the Engineer's Report dated April, 1986 at an estimated cost of
$1,999,400.00 to service the lands defined in Schedule "A" attached
hereto.

The Town shall ass~ne a portion of the total cost being $125,900.00; the
remaining cost being $1,873,500.00 shall be specially assessed against
those lands outlined in Schedule "B" attached hereto wiN] difference
proportions of benefit therefrom.

The firm of Fred $chaeffer and Associates Limited is hereby authorized to make
such plans, profiles and specifications and furnish such plans and information
as may be necessary for the making of contracts for doing the works or for
carrying out the same, and the works shall be carried on and executed under the
superintendence and accordance to the direction and orders of the Engineer of
the Corporation of the Town of Pickering.
The cost of the works, estimated at $1,999,400.00 is to be paid by the issuing
of debentures bearing interest at the rate of eleven (11) per centum and is to
be repaid by the special assessments over a term of ten (10) years.
The Treasurer may, subject to the approval of Council, agree with any bank or
person for temporary advances of money to meet the cost of the works pending
completion thereof.
Any person whose land is specially assessed may co~nute, by a payment in cash,
the special rate imposed by paying the cost of construction assessed upon such
land without interest until the special assessment roll has been certified by
the Clerk, and with interest as set out in Section 3, both co~nuted at the
rate of three per cent below bank prime on the day of co~nutation, after the
special assessment roll has been certified by the Clerk.
This by-law shall not come into effect until the approval of the Ontario
Municipal Board to the undertaking herein is obtained.
