BY-LAW NUMBER 3429/90
Being a Zoning By-law to amend By-law 2457/87, which amended Restricted
Area (Zoning) By-law 3036, as amended, to implement the Official Plan of
the Town of Pickering District Planning Area in Part of Lot 31, Range 3,
Broken Front Concession in the Town of Picketing.

WHEREAS the Council of the Corporation of the Town of Pickering passed By-law
2457/87, amending By-law 3036, to permit the establishment of offices and residential
dwellings in Part of Lot 31, Range 3, Broken Front Concession}
AND WHEREAS the Council of the Corporation of the Town of Picketing now deems it
desirable to amend By-law 2#57/87 to also permit the development of a restaurant, and an
automotive service station in Part of Lot 31, Range 3, Broken Front Concession}
NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE TOWN OF
PICKERING HEREBY ENACTS AS FOLLOWS:
l. TEXT AMENDMENTS
Section 2 of By-law 2457/87 is hereby revoked and the following substituted therefor:
2. AREA RESTRICTED
The provisions of this By-law shall apply to those lands in Lot 31, Range 3,
Broken Front Concession, Picketing, designated "SC-22/GS3" and "R4" on
Schedule "I" attached hereto.
2. Section 4 of By-law 2457/87 is hereby amended by adding thereto the following
definitions:
(6) "Automobile Service Station - Type A" shall mean an establishment where
vehicle fuels, lubricants and accessories are offered for retail sale;
(7) "Restaurant - Type A" shall mean a building or part of a building where food is
prepared and offered or kept for retail sale to the public for immediate
consumption on the premises or off the premises, or both on and off the
premises;
(3) Section 5 of By-law 2457/87 is hereby revoked and the following substituted therefor:
5. PROVISIONS
(1) Uses Permitted ("SC-22/GS3" Zone)
No person shall within the lands designated "SC-22/GS3" on Schedule "I"
attached hereto use any lot or erect, alter or use any building or structure
for any purpose except the following:
(a) automobile service station - type A
(b) business office
(c) professional office
(d) restaurant - type A

(2) Zone Requirements ("SC-22/GSY' Zone)
No person shall within the lands designated "SC-22/GS3" on Schedule "l"
attached hereto, use any lot or erect, alter or use any building or structure
except in accordance with the following provisions:
(a) LOT AREA (minimum): 0.3 hectare
(b) FRONT YARD DEPTH (minimum): lq metres
(c) INTERIOR SIDE YARD WIDTH
(minimum): 10 metres
(d) FLANKAGE SIDE YARD WIDTH
(minimum): 14 metres
(e) REAR YARD DEPTH (minimum): I metre
(f) LOT COVERAGE (maximum): 33 percent
(g) BUILDING HEIGHT (maximum): 10 metres
(h) OPEN STORAGE: no open storage shall be
permitted in any yard
(i) PARKING REQUIREMENTS:
A For the purpose of this clause "parking space" shall mean a usable
and accessible area of not less than 2.6 metres in width and 5.3
metres in length for the temporary parking of a vehicle, but shall
not include any portion of a parking aisle or driveway;
B There shall be provided and maintained a minimum of 47 parking
spaces;
C Sections 5.21.2a) and 5.21.2b) of By-law 3036, as amended, shall not
apply to the lands designated "SC-22/GSY' on Schedule "I" attached
hereto;
D All parking areas shall be set back a minimum of 3.0 metres from
all road allowances;
E Despite Section 5.21.2g) of By-law 3036, as amended, all parking
areas shall be surfaced with brick, asphalt or concrete, or any
combination thereof.
(j) SPECIAL PROVISIONS:
A The aggregate of the gross floor areas of all buildings on the lot
shall not be less than 600 square metres and shall not exceed 1050
square metres;
B The aggregate of the gross floor areas of all restaurants - type A,
on the lot shall not exceed 240 square metresl
C Despite Section ~.lg of By-law 3036 as amended, and Section ~(2)(d)
of this By-law as amended~ the following structures accessory to an
automotive service station type A may be erected in a flankage
side yard not less than 7.5 metres from the lot line:
(a) a canopy not exceeding 12 metres in height and having a
maximum lot coverage of 3 percent; and
(b) a kiosk not exceeding 3 metres in height and not exceeding 6
square metres in gross floor area.

2. SCHEDULE AMENDMENTS
Schedule "I" to By-law 2#57]87 is hereby amended by changing from "SC-9" to
"SC-22/GS3" the zone designation ot the lands designated "SC-22/GS3" on Schedule
attached hereto.
3. BY-LAW 2t457/g7
By-law 2#57/87 is hereby amended only to the extent necessary to give effect to the
provisions of this By-law. Definitions and subject matters not specifically dealt with
in this By-law shall be governed by the relevant provisions of By-law 20,57/87 and
By-law 3036, as amended.
EFFECTIVE DATE
This By-law shall take effect from the day of passing hereof, subject to the approval
of the Ontario Municipal Board, if required.
