BY-LAW NUMBER 3766/91
Being a Zoning By-law to amend By-law 2802/88, which amended
Restricted Area (Zoning) By-law 3036, as amended, to implement the
Official Plan of the Town of Pickering District Planning Area, Region of
Durham, in Part of Lot 20, Concession 1, in the Town of
Pickering. (A 27/90)
WHEREAS the Council of the Corporation of the Town of Pickering passed By-law
2802/88, amending By-law 3036, as amended, to permit the establishment of an office
development with limited retail and personal service uses on lands being Part
of Lot 20, Concession 1, Town of Pickering;
AND WHEREAS the Council of the Corporation of the Town of Picketing now deems
it desirable to further amend By-law 2802/88, to permit the establishment of a drug
store, dr,/cleaning establishment - non-venting, take-out restaurant, and video store on
lands being Part of Lot 20, Concession 1, Town of Pickering;
NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE TOWN
OF PICKERING HEREBY ENACTS AS FOLLOWS:
1. TEXT AMENDMENTS
(1) Clause (16) of section 4 of By-law 2802/88 is hereby revoked and the
following substituted therefor:

"Restaurant-Type A" shall mean a building or part of a building
Where food ii prepared and offered or kept for retail sale to the
public for immediate consumption on the premises or off the
premises, or both on and off the premises;
(2)
Section 4 of By-law 2802/88, is hereby amended by adding thereto the
following clauses:
(3a)
"Drug Store" shall mean a building or part of a building in which
pharmaceutical prescriptions are compounded and dispensed to the
public, and where medicine, medical supplies and associated
merchandise, confectionery items, cosmetics, toiletries, periodicals,
or similar items of day-to-day household necessity are stored,
displayed and offered for retail sale;
(4a)
"Dry. Cleanine Establishment - Non-Venting" shall mean a building
or part of a ~uilding where a dry cleaning plant, with a dry weight
capacity of 27 kilograms which does not vent gases or odors and is
operated separately or in association with, dry-dyeing, cleaning,
laundering, pressing or incidental tailoring or repair of articles or
goods of fabric is carried on, in which only non-flammable fabrics
are or can be used, which do not omit noxious odors or fumes and in
which no noise or vibration causes a nuisance to neighbouring
premises;

"Video Store" shall mean a building or part of a building in which
video cassette recorders and tapes and accessories thereto are
stored, serviced, displayed and offered for rent or retail sale to the
public for use off the premises only;

Item (n) of section 5(1) of By-law 2802/88 is hereby revoked and the
following substituted therefor:
(n) restaurant - type A

Section 5(1) of By-law 2802/88 is hereby amended by adding thereto the
following items:
(o) drug store
(p) dry cleaning establishment - non-venting
(q) video store
(5)
Subclauses (iii) and (v) of section 5(2)(e) of By-law 2802/88 are hereby
revoked and the following substituted therefor:
(iii) The aggregate gross leasable floor areas of all drug stores, food
stores, neighbourhood convenience stores, and video stores shall not
exceed of 660 square metres;
(v)
The aggregate gross leasable floor areas of all restaurants - type A
shall not exceed 25 percent of the total gross leasable floor area of
the building.
BY-LAW 2802/88
By-law 2802/88 is hereby amended only to the extent necessary to give effect to the
provisions of this By-law. Definitions and subject matter not specifically d~alt with in
this By-law shall be governed by the relevant provisions of By-law 2802/88, and By-law
3036, as amended.
EFFECTIVE DATE
This By-law shall take effect from the day of passing hereof subject to the approval of
the Ontario Municipal Board, if required.
