HomeMy WebLinkAboutBy-law 3730/91THE CORPORATION Q~THE T~35[N OF PICKERING BY-LAW NO, 3730/9~1 Being a by-law to authorize the execution of a Release and Discharge of the Subdivision Agreement respecting Plan 40M-1392, Picketing. WHEREAS, pursuant to the Planning Act, 1983, S.O. 1983, c.l, s.50, or a predecessor thereof, The Corporation of the Town of Picketing and Olenellen Developmem Corporation entered into an Agreement dated August 6, 1985, Notice of which was registered on February 10, 1986 as Instrument No. LT260228, respecting the subdivision and development of Plan 40M-1392, Picketing; and WHEREAS the terms and conditions of that Agreement have been complied with to the satisfaction of the Town; NOW THEREFORE, the Council of The Corporation of the Town of Picketing HEREBY ENACTS AS FOLLOWS: The Mayor and Clerk are hereby authorized to execute a Release and Discharge, in the form attached hereto as Schedule A, of the Agreement dated August 6, 1985, Notice of which was registered February 10, 1986 as Instrument No. LT260228, between Glenellen Developmem Corporation and The Corporation of the Town of Pickering, respecting the subdivision and development of Plan 40M-1392, Picketing. 2. Schedule A hereto forms part of this By-law. BY-LAW read a first, second and third time and finally passed this 3rd day of June, 1991. TOWN CF PICKERINQ APPROVED LEGAL DEPT RELEASE AND DISCHARGE WHEREAS the Agreemem dated August 6, 1985, Notice of which was registered February 10, 1986, in the Land Registry Office for the Land Titles Division of Durham (No. 40) as Instrument No. LT260228, between, GLENELLEN DEVELOPMENT CORPORATION hereinafter refented to as the "Company" THE CORPORATION OF THE TOWN OF PICKERING hereinafter referred to as the "Town", provided for the subdivision and development of lands affected hereby; and WHEREAS the terms and conditions of that Agreement have been complied with to the satisfaction of the Town with respect to the lands affected hereby', THE TOWN HEREBY remises, releases and forever discharges the Company, its successors and assigns, from any and all liabilities, actions, causes of action, debts, claims or demands of any kind whatsoever which the Company may have been, is, or may become subject to pursuant to the provisions of the Agreement. THIS RELEASE AND DISCHARGE affects the lands described as: Lots 1-23, inclusive, Blocks 24 and 25, Dahlia Crescent and Maitland Drive, Plan 40M-1392, Town of Pickering, Regional Municipality of Durham. IN WITNESS WHEREOF the Town has hereunto affixed its corporate seal, attested to by its properly authorized officers. DATED at Pickering, Ontario this 3rd day of June, 1991.
