Being a by-law to attthorize the execution of a Transfer
of Easement fi'om The Corporation of the Town of
Pickering to William Peak Co-Operative Homes
respecting an easement over Block 35, Plan 40M-1643,
Pickering, for sanitary se wet' purposes.
WHEREAS William Peak Co-Operative Homes Inc. requires a private sanitary sewer easement over
Block 35, Plan 40M-1643, Picketing, which block is owned by The Corporation of the Town of
Picketing; and
WHEREAS pursuant to section 193 of the Municipal Act, R.S.O. 1980, chapter 302, the Council of the
Town may pass by-laws for disposing of interests in lands;
NOW THEREFORE, the Council of The Corporation of the Town of Pickering HEREBY ENACTS AS
FOLLOWS:
The Mayor and Clerk are hereby authorized to execute a Transfer of Easement, in the form
attached hereto as Schedule A, from The Corporation of the Town of Pickering to William
Peak Co-Operative Homes Inc. over Block 35, Plan 40M-1643, Pickering, respecting a private
sanitary sewer easement.

INTEREST/ESTATE TRANSFERRED
The Transferor hereby transfers to the Transferee the
right and easement subject to any other easements
previously granted to construct, operate and maintain a
private sanitary sewer together with any appurtenances
thereto as may be required under and across the lands
herein described, provided same does not interfere or
conflict with any other works or appurtenances thereto
already installed under or across the lands, together
with a right of the Transferee, its successors and
assigns and its and their servants, agents and workmen,
with all necessary equipment, machinery and vehicles to
enter upon the lands at all times and to pass and repass
thereon for replacing and maintaining the sanitary sewer
or any part thereof or appurtenances thereto to be
constructed, reconstructed, examined, repaired, renewed,
replaced or maintained situate on the lands, provided
same does not interfere or conflict with any other works
or appurtenances thereto already installed under or
across the lands.
The burden of this Transfer and of all the covenants
contained herein shall run with the lands herein
described.
This Transfer shall be binding upon and shall enure to
the benefit of the parties hereto and their respective
successors and assigns.
LAND BENEFITED (DOMINANT TENEMENT)
The benefit of this Transfer and all of the covenants
contained herein shall run with all lands and interests
in land owned, occupied or used by the Transferee, its
successors and assigns, being Part of Lot 29, Concession
1, Town of Pickering, Regional Municipality of Durham.
