The Corporation of the City of Pickering
By-law No.
Being a by-law to exempt Block 1, Plan 40M-2697,
Pickering, from the part lot control provisions of the
Planning Act.
Whereas pursuant to the provisions of section 50(7) of the Planning Act, R.S.O. 1990,
chapter P.13, as amended, the Council of a municipality may by by-law provide that
section 50(5) of the Act does not apply to certain lands within a plan of subdivision
designated in the by-law;
And Whereas Altona Land Development Corporation, the owner of Block 1, Plan 40M-
2697, intends to obtain approval of, and register a common elements condominium plan
on the lands;
And Whereas the proposed common elements condominium plan is to consist of 22
townhouse dwelling units;
And Whereas it is intended that the owner or owners of each of the 22 townhouse
dwelling units will own the parcel of tied land on which his, her or their dwelling is
located, in fee simple and will also be a member or members of the common elements
condominium corporation;
And Whereas it is intended that the parcels of tied lands on which the 22 townhouse
dwelling units are to be constructed will be subdivided by means of an exemption from
the part lot control provisions of the Planning Act, R.S.O. 1990, chapter P.13.
Now therefore the Council of The Corporation of the City of Pickering hereby enacts as
follows:
1.Section 50(5) of the Planning Act, R.S.O. 1990, chapter P.13, shall cease to
apply to Block 1, Plan 40M-2697, upon:
(a)registration of this By-law in the Land Registry Office for the Land Titles
Division of Durham (No. 40); and
(b)registration of a restriction, pursuant to Section 118 of the Land Titles Act,
R.S.O. 1990, chapter L.5, requiring the consent of the Solicitor for The
Corporation of the City of Pickering to the registration of any transfer or
charge of any portion of Block 1, Plan 40M-2697 in the Land Registry
Office for the Land Titles Division of Durham (No. 40).

2.This By-law shall remain in force and effect for a period of two years from the
date of the passing of this By-law and shall expire on December 5, 2024.
