Moved by Councillor Brenner 54 Seconded by Councillor Holland WHEREAS the Council of the Corporation of the City of Pickering enacted By-laws 5476/99, 5477/99 and 5478/99 to amend the urban area Comprehensive Zoning By-laws 2511, 2520 and 3036, respectively, with the intent to allow various types of commercial vehicles that are deemed appropriate or compatible due to their size to park off-road in urban residential areas; and WHEREAS the effect of these amendments was to allow tow trucks, that are not considered to be in character with a quiet residential neighbourhood, to park off-road in urban residential areas; and Council Meetine Agenda 1-~IC~~ Monday, December 17, 2001 7:30 P.M. WHEREAS the off-road parking regulations established by the amendments should be re- examined based on feedback over the past two years from residents who have expressed that tow trucks are not appropriate in residential areas; NOW THEREFORE the Council of the Corporation of the City of Pickering hereby directs the Director, Planning & Development to prepare a report on the feasibility of prohibiting tow trucks in urban residential neighbourhoods; and FURTHR THAT the Director, Planning & Development report back to Council no later than March 31, 2002 on this matter. CARRIED: MAYOR Appendix I Committee of the Whole Report COW-2001-15 That the Committee of the Whole of the City of Picketing having met on December 10, 2001, presents its fifteenth report to Council and recommends: CHIEF ADMINISTRATIVE OFFICER REPORT CAO 10-01 NUCLEAR EMERGENCY PUBLIC ALERT1NG DUKE ENGINEERING - PRELIMINARY DESIGN REPORTS That Report to Council CAO 10-01, concerning the Preliminary Design Reports by Duke Engineering for the 3 km Contiguous Zone and the 3-10 km Primary Zone around the Picketing Nuclear Generating Station (PNGS), be received; and That Council reaffirm its commitment to public alerting throughout the entire Primary Zone around PNGS; and 10 km That Council endorse the Preliminary Design Report for the 3 km Contiguous Zone as the basis for implementing a public alerting system within this zone; and That Council endorse the Preliminary Design Report for the 3-10 km Primary Zone as the basis for implementing a public alerting system within this zone, and that on the basis of the Duke Engineering Report, Council advise that it is open to other options for alerting within the Primary Zone so long as the intent of alerting within this zone is met and that funding no fall to the Region or the City; and That a copy of this Report be forwarded to the Solicitor General and Minister Correctional Services, and that the Province be urged to: a) accept the Duke Engineering Preliminary Design Report for the 3 km Contiguous so that implementation can begin immediately; and b) amend the Interim Provincial Nuclear Emergency Plan to require public alerting extend to the entire 10 km Primary Zone; and c) accept the Duke Engineering Preliminary Design Report for the 3-10 km Primary or propose an alternate solution so that public alerting can be extended to this zone. BACKGROUND: 1.0 Discussion On October 2, 2000, Pickering Council considered Planning & Development Report PD 42-00 respecting delegation of approval authority from the Region of Durham to the City of Pickering, for draft plans of subdivision, condominium and part lot control exemption by-laws. City Council, through Resolution #126/00, recommended that the Region of Durham and the Province be requested to delegate the approval authority for draft plans of subdivision, condominium and part lot control exemption by-laws to the City of Pickering commencing July 1,2001, in accordance with the Memorandum of Understanding/Agreement. Report to Council PD 43-01 Date: November 27, 2001 Subject: Delegation of Approval Authority for Draft Plans of Subdivision and Condominium Descriptions Page 2 0O5 On May 22, 2001 City Council revised the date for the commencement for the delegation of approval to January 2, 2002. As part of the October 2, 2000 City Council resolution, Git>' Council authorized the Director, Planning & Development or designate thc administrative responsibilities for the approval of draft plans of subdivisions and condominium currently delegated to the Regional Commissioner of Planning including thc authorization to sign final plans of subdivision and condominium ibc registration. Section 51.2 of the Planning Act, R.S.O. 1990, c. P. 13 as amended, permits City Council to delegate all or anv part of the authority to approve plans of subdivision or condominium description to an appointed officer where the authority to approve plans of subdivisions or condominium has been delegated to tile Council. On November 14, 2001 the Regional Municipality of Durham adopted By-law 77-2001 that delegated the authority to approve applications Ibc plans of subdivisions or condominium description to City Council (Attachment No. 3 ). In order to obtain greater efficiency in the administration of the approval authority for plans of subdivisions or condominium description and to implement Council Resolution 126-00, Item 4, it is deemed expedient to delegate certain authorities to the Director of the Planning & Development Department. This is the same process that has been implemented by other Durham Region lakeshore municipalities that have received delegation authority. WHEREAS subsection 51 (5) of the Planning Act, R.S.O. 1990, c. P. 13, as amended (the "Planning Act") provides that Regional Council is the approval authority for all plans of subdivision in the Regional Municipality of Durham (the "Region"); AND WHEREAS subsection 51.2(2) of the Planning Act provides that Regional Council may, by by-law, delegate subdivision approval authority to an area municipality in respect of lands situate in the area municipality; AND WHEREAS subsection 50(2) of the Condominium Act, R.S.O. 1990, c. C.26, as amended (the "Condominium Act") provides that the provisions of section 51 of the Planning Act apply with necessary modifications to the approval of condominium descriptions; AND WHEREAS in order to obtain greater efficiencies in the administration of the approval of plans of subdivision, condominium descriptions and pad-lot control exemption by-laws, the Region delegated approval authority to the City of Oshawa, the Town of Ajax and the Town of Whitby by By-law No. 56-2000, and to the Municipality of Clarington by By-law No. 62-2001. AND WHEREAS the Region now wishes to delegate approval authority to the City of Pickering. NOW, THEREFORE, BE IT ENACTED AND IT IS HEREBY ENACTED as a by-law of The Regional Municipality of Durham by the Council thereof as follows: Delegation The authority for approving plans of subdivision and approving or exempting condominium descriptions shall be delegated to the City of Pickering effective January 2, 2002, with respect to lands situated in the City of Pickering. On January 2, 2002, all applications for subdivision or condominium approval received by the Region that have not received final approval shall be transferred to the City of Pickering. In exercising the authority delegated by section 1 of this by-law, the City of Pickering shall comply with all the provisions of the Agreement between the Region and the area municipalities dated October 4th, 2000. ORIGIN: Request from the Council of the Town of Ajax. AUTHORITY: Municipal Act, R.S.O. 1990, chapter M.45, section 210.111. FINANCIAL IMPLICATIONS: No direct costs are anticipated to the City as a result of this proposal. EXECUTIVE SUMMARY: The Council of the Town of Ajax directed staff to obtain comments from the Council of the City of Pickering regarding the City's position on two specific issues related to the Ajax proposal to rename portions of Picketing Beach Road and Salem Road in the Town of Ajax (see Attachment #1 - Location Map). The first request was to determine whether City Council agrees that one street name be used between the future interchanges of Highway 401 and Highway 407 along portions of Salem Road and Pickering Beach Road. The second request is for City Council's position on whether the City prefers the use of Carruthers Creek Drive or Salem Road in both Ajax and Picketing, should City Council decide that one street name be utilized between the interchanges. It is recommended that City Council support the use of one street name between the Highway 401 and Highway 407 future interchanges and that Salem Road be selected as the preferred street name. The street name "Salem Road" holds historical significance with the City and the continued use of this name will also avoid impacts on Picketing residents, and the disruption and costs inherent in any street name change. Report to Council PD 44-01 Subject: Potential Street Renan'ting xvitldn the Toxvn of.ajax and City of Picketing (Salem Road) Date: December 6, 2001 Page 2 013 Salem Road is also preferred by the MTO from a safctx perspectixc as the name is shorter and requires less attention away from the road by the driver. Further. until the exact location of the future Highway 407 interchange is decided, it is premature to change the name of Salem Road. BACKGROUND: The Tov,'n o£ .,jax is currently in tile process of renaming tile portion of Picketing Beach Road, north of Bayly Street, as well as the realigned portions and unbuilt portions, to coincide with the opening of a new interchange at Highway 401 in the Town of Ajax. We have been advised that the Council of tine Town of Ajax passed a resolution to rename portions of Picketing Beach Road and Salem Road, in Ajax, to Carruthers Creek Drive up to Taunton Road from which point the name Salem Road will continue to be used. it is our understanding that during discussions at tine Town of Ajax Community Affairs and Planning Committee it was expressed that it would be preferable to have one continuous street name for the length of road between thc 401 interchange and the tkm~rc 407 interchange. The use of one continuous road name ,,','as encouraged as it would minimize confusion fox' Emergency Services and would avoid confusion t'or thc traveling public in both Ajax and Picketing. Proposed Usc Of One Street Name Between The Future Interchanges: The Town of Ajax has posed a question to the City of Picketing regarding our preference for one continuous street name between the future interchanges at Highway 401 and Highway 407. It is recommended that City Council support the use of one street name between both interchanges for the same reasons, outlined above that were raised at thc Community Affairs and Planning Committee of the Town of Ajax. The Ministry of Transportation has indicated that they concur that one street name should be used between both interchanges and that while tine,.' would support the use of either name it is their preference that Salem Road be selected as it is a shorter name and requires less attention away from the road for the driver (see Attachment ~2). Salem Road in Picketing: The City of Picketing has approximately 27 lots that tmvc a Salem Road municipal address and are made up of residential\agricultural lots and one nine-bolo public golf course. There are two properties on the east and west side of Salem Road whictq fom~ tho Salem Road Cemetery and church. These owners would all need to go through an address change ii' the street name were to change. The cemetery and church provide a historical reference to how long the name Salem has been used in Picketing. The City's records indicate that the cemetery has been in existence since the mid-1800's. In addition, an article in the News Advertiser printed in .lunc 1999, provides a brief history of the cemetery and an explanation of xvbere tine name Salem originated (see Attachment #3). Based on the information contained within the article it appears that the church and cemetery received its name from the biblical name which means meeting place or place to worship. Salem Road vs. Carruther Creek Drive: On December 3, 2001, Ajax Planning Staff forwarded a report to tile .ajax Community Affairs and Planning Comnfittee with a recommendation to rename portions of Pickenng Beach Road and Salem Road in the Town of Ajax to Carruthers Creek Drive Isee Attachment # 4 Ajax Staff Report). The proposed renaming was approved that sarne evening and Ajax Council endorsed the recommendation of their Community Affairs and Planning Committee on December 10, 2001. 014 Report to Council PD 44-01 S ubj ect: Potential Street Renaming within the Town of Ajax and City of Picketing (Salem Road) Date: December'6,200i Page 3 The precise location of Highway 407 interchange location in Picketing has not yet been determined through an Environmental Assessment Report process. Consequently, although anticipated, it may be premature to conclude that there will be an interchange at Highway 407 and Salem Road. City Staff in the Planning & Development Department provided verbal notification of our intent to obtain Pickering Council's position on December 17, 2001, and Aj ax Staff indicated that their report would await Pickering's consideration of the matter, and follow sometime in January, 2002. Despite the decision of the Town of Ajax, on December 10, 2001, it is recommended that the City of Pickering retain the name "Salem Road" for the section of road within the City and further recommend that the Town of Ajax reconsider its position on the matter and select Salem Road as the street name to be used between the Highway 401 and Highway 407 interchanges. A ceremony and church service are being held Sunday, June 27, start- ing at 2:30 p.m. to mark the occasion. Among the highlights are a tree- planting ceremony and re-dedication of the cemetery gates. Salem Road resident William Brown reports this weekend's Salem Sunday celebrations will be more ela_bgrate than in :~~. .- For example, former Salem Church ministers on what was once called the Greenwood Circuit have been invited hack for the ceremonies. Some of the first Circuit ministers were' 'saddle-bag preachers'~ who travelled around on horseback; Since those saddle-bag preachers only came around on occasion, cou- ples who wanted to get ~narried and got to the church on !ime just,~ad to. wait until the minist~r:r~de They often came to the rescue of George Gamble, who was instrumen- tal in building up the church in the mid-180Os. A school teacher who preached on Sundays, he .couldn't perform wad- ding ceremonies because he wasn't a minister. Appropriately named after the bib- lical name salem, which means a meeting place or place to worship,. Salem Church and the accompanying cemetery have a history'that dates back to 1837, when John Adamson donated a small piece of land where the church now stands. The original wood-frame church was bricked over in 1880 to become the building it is today. As for the cemetery, white slab marble was used for tombstones, in- cluding some shipped from Scotland. Large stones were erected because a death was a great loss to a family, who wanted to remember the de- ceased with a large monument, Mr. Brown reports. A big tombstone was also a sign of respectability for a fam- ily. The Mowbray family stone, for example, was almost t0 feet high and cost $500 to be transported from Scotland. The first person buried thei'e was Ester Little in 1837. The cemetery has since been ex- panded on bot[n the west and east sides of Salem Road. One acre of land on the east side was bought in 1940 for $300, but not by Harry. Jones who'd wanted to get his hands on the property. Ironically, Mr. Jones was 'the first person buried on the east side after he died in 1941. And countless numbers of peopl'e haYe been interred ihere since. At the CAP meeting on April 17, 2001, concerns were expressed by some individuals with the name itself (i.e. Carruthers Creek Drive [too long]) and with the fact that there would be different names at the 401 and 407 interchanges for the same road. It was during this meeting that the idea of using the name "Salem Road" at beth interchange locations was suggested. ANALYSIS: At this juncture, staff have received a response from both the MTO and the Region of Durham (attached), but are currently awaiting a response from the City of Pickering. This matter is not scheduled to come before Picketing Council until December 10, 2001; however, it is our understanding that Picketing staff wilt be recommending that the name Salem Road be used for both the 401 and 407 interchanges. Their rationale is not so much or so strong an attachment to Salem Road as it is the simplicity of maintaining the status quo. It is not believed that Picketing staff has any objection to the name "Carruthers Creek Drive". In response to the questions of: a) whether the street name should be consistent at both the 401 and 407 interchanges; and b) the preferred street name, the responses from the MTO and the Region are as summarized below. The letter from the MTO states, "In orderto provide consistency to the traveling public and emergency services, the Ministry's preference is to use one name for the road between Highway 40'1 and future Highway 407, Given the option, the Ministry would prefer the selection of Salem Road over Carruthers Creek Drive as it is shorter and therefore requires less attention away from the road for the driver. This indicates our support for using any of the two names considered appropriate by the Town of Ajax." Staff have considered th'e issues raised by concerned residents, and the comments received from the MTO, the Region and verbally from Pickering staff and are suggesting that the Town's position on this matter be as follows: ~) The Town's preference is to have a consistent street name at both the 401 and the 407 interchanges; ii) The Town's preference is to use the name"Carruthers Creek Drive" between Highways 401 and 407; The Town of Ajax should consider requesting the City of Pickering to rename Salem Road to Carruthers Creek Drive; and, iv) The Town of Ajax should proceed with the necessary street renaming process to formalize Carruthers Creek Drive between Bayly Street and Taunton Road. DISCUSSION: Staff agree that it would be preferable (for the sake of simplicity), to use a consistent street name for the same road at the Highway 401 and 407 interchanges. Having said that, staff are also of the view that the name "Carruthers Creek Drive" is a more inviting and marketable name than Salem Road. The significance behind the name Salem Road is unclear and to some, it may have a negative connotation. Some have stated that the name "Carruthers Creek Drive", with a length of 20 characters, is too long to be used at a freeway interchange. Staff reject this argument and can point to several examples of similar length streets that intersect with a 400-series highway (e.g, Winston Churchill Boulevard, Major Mackenzie Drive, Victoria Park Avenue, William R. Allen Road, Burnhamthorpe Road). The formal name of Highway 401 itself is the McDonald-Cartier Freeway which has 22 characters. CONCLUSION: While the convenience of having the same name at Highway 401 and 407 might have its advantages, staff do not feel the perceived convenience should outweigh the importance of having an inviting and marketable name for the new Mighway interchange in Ajax for what will be a prominent arterial road through Town. Staff believe the Town should explore with the City of Pickering whether it might be prepared to rename Salem Road to Carruthers Creek Drive. If Pickering agrees, obviously the portion of Salem Road between Taunton Road and the Fifth Concession Road would also have to be renamed Carruthers Creek Drive. As I said to you on the phone, I am disappointed thzt the Planning department seems determined to go forward with the original proposal to introduce the name "Carruthers Creek Drive" and thus bestow three different names on 8 Km of road within the boundaries of Ajax. That proposal contravenes the KISS principle that I outlined in my previous presentation to Council. I firmly believe that the naming issue should be kept SIMPLE and SENSIBLE. After the previous meeting, letters were sent to Ontario Department.of Highways, Durham Kegion and thc City of Picketing. It is my understanding that the first two did NOT cndorse the Carruthers Creek name and the third has yet to reply, although one of their planning staffhas indicated to me that therc is no good reason for Picketing to change the name from Salem. Another member of Ajax staff has indicated to me that Salem has "negative connotations" and would not be as easy to promote as Carruthers Creek. By "negative connotations" i have to assume ttm allusion is to "witches". That being so, I have to point out that that outlook betrays a prejudice and ignorance of history. Do you know how many witches were burned in Salem ? The answer is actually NONE; common sense prevailed over prejudice. The kind of thinking in that "negative correlation" outlook is reminiscent of the recent proposal at Durham Regional School Board to ban the Harry Potter books. In fact, no other book has been so widely read by students and a great many non-readers have been turned into avid readers by J.K. Rowlings. "Salem" is far simpler and every bit as promotable as the proposed alternative. At present "Salem" may not be as recognizable to many people in Ajax but "Carruthcrs Creek" was even more unknown before the misguided effort to add it to the 2 names already on that stretch of REPOR~ ~ Pg '-/~- o t ionTWame - Salem Roadrff .... After my previous presentation when I pointed to Yonge Street as one thoroughfare maintained ~ts name from Lake Ontario up to Richmond Hill and beyond, Mayor Parish drew my attention to University Avenue which changes to Avenue Road at Bloor. My response to that is that the situation probably arose in the horse and buggy age when it might have taken most of a day's journey to get from Lake Ontario to Bloor Street. In thc next expansion of Highway 407 beyond Brock Road in Pickcring there will be an interchange at 407 and Salem. When a driver exits there and heads south in a car, how long would it take to get to the proposed end o£Salem and onto Carruthers Creek? Less than five minutes ! And in approxhmately the same number of minutes that same driver would be expected to adjust to the name "Picketing Beach Road", in the Town of Ajax no tess. That could lead to confusion and perhaps a passing thought as to the perspicacity of the group of people who saw fit, in the twenty-first centuw, to g~vc three different names to one 8 Km section of road. I fervently hope that when the planning proposal is presented to the committee of Council on December 3,d that a more rational view will prevail and SALEM ROAD will stretch not only from the Ninth concession in Pickering to Taunton Road, but beyond that to Highway 401 and even South of that. DEFINITIONS In this By-law, (1) (a) "Dwelling2~ shall mean a building or part of a building containing one or more dwelling units, but does not include a mobile home or trailer', (b) "Dwelling Unit" shall mean one or more habitable rooms occupied or capable of being occupied as a single, independent and separate housekeeping unit containing a separate kitchen and sanitary facilities; (c) "Dwellin~ or Single Dwelling" shall mean a single dwelling containing one dwelling unit and uses accessory hereto: (d) "Dwellin~tached or Detached I)wellin~2" shall mean a single dwelling, which is freestanding, separate and detached Ii'om other main buildings or structures. (2) (a) "Floor Area-Residential" shall mean tile area of the floor surface contained within the outside walls of a storey or part of' a storey; (b) "Gross Floor Area-Residential" shall meau the aggregate of the floor areas of all storeys of a building or structure, or part thereof as thc case may be, other than a private garage, an attic or a cellar. (3) (a) "Lot" shall mean ail area of land fronting on a street which is used or intended to be used as tile site ora building, or group of buildings, as the case may be, together with any accessoo' buildings or structures, or a public park or open space area, regardless of whether or not such lot constitutes the whole of a lot or block on a registered plan of subdivision; 030 -2- (b) "Lot Coverage" shall mean the percentage of lot area covered by all buildings on the lot; (c) "Lot Frontage" shall mean the width of a lot between the side lot lines measured along a line parallel to and 7.5 metres distant from the front lot line. (4) "Private Garage" shall mean an enclosed or partially enclosed structure for the storage of one or more vehicles, in which structure no business or service is conducted for profit or otherwise. (a) "Yard" shall mean an area of land which is appurtenant to and located on the same lot as a building or structure and is open, uncovered and unoccupied above ground except for such accessory buildings, structures, or other uses as are specifically permitted thereon; (b) "Front Yard" shall mean a yard extending across the full width of a lot between the front lot line of the lot and the nearest wall of the nearest main building or structure on the lot; (c) "Front Yard Depth" shall mean the shortest horizontal dimension of a front yard of a lot between the front lot and the nearest wall of the nearest main building or structure on the lot; (d) "Rear Yard" shall ~nean a yard extending across the full width of a lot between the rear lot line of the lot, or where there is no rear lot line, the junction point of the side lot lines, and the nearest wall of the nearest main building or structure on the lot; (e) "Rear Yard Depth" shall mean the shortest horizontal dimension of a rear yard of a lot between the rear lot line of the lot, or where there is no rear lot line, the junction point of the side lot lines, and the nearest wall of the nearest main building or structure on the lot: (f) "Side Yard" shall mean a yard of a lot extending from the front yard to the rear yard and from the side lot line to the nearest wall of the nearest main building or structure on the lot; (g) "Side Yard Width" shall mean the shortest horizontal dimension of a side yard ora lot between the side lot line and the nearest wall of the nearest main building or structure on the lot; (h) "Flankage Side Yard" shall mean a side yard immediately adjoining a street or abutting on a reserve on the opposite side of which is a street; (i) "Flankage Side Yard Width" shall mean the shortest horizontal dimension of a flankage side yard ora lot between the lot line adjoining a street or abutting on a reserve on the opposite side of which is a street and the nearest wall of the nearest main building or structure on the lot; and (j) "Interior Side Yard" shall mean a side yard other than a fiankage side yard. 5. (xiii) MODEL HOMES: A despite the provisions of Section 6.1 of By-law 3036, a maximum of one Model Home, together with not fewer than three parking spaces per Model Home, may be constructed on the lands set out in Schedule I attached hereto prior to division of those lands by registration of a plan of subdivision. B for the purposes of this By-law, "Model Home" shall mean a dwelling unit used exclusively for sales display and for marketing purposes pursuant to an agreement with the City of Pickering, and not used for residential purposes. 6. BY-LAW 3036 By-law 3036, as amended, is hereby further amended only to the extent necessary to give effect to the provisions of this By-law as it applies to the area set out in Schedule 1 attached hereto. Definitions and subject matter not specifically dealt with in this By-law shall be governed by the relevant provisions of By-law 3036, as amended. 7. Halliday and R. Halliday in Trust Part of Lot 20, Concession 2 (Lands east of Valley Farm Road, at the southern terminus of Wildwood Crescent) City of Pickering City Council, on September 17, 2001, approved zoning by-law amendment application A 28/00, as revised to permit the establishment of four detached dwellings on new lots and to retain the existing Palmer-Voss Heritage House on an additional lot, subject to various conditions being fulfilled. Council's conditional approval permits, among other things, the establishment of four detached dwellings on lots providing minimum lot frontages of 12.0 metres. The enclosed draft implementing zoning by-law permits the development of lots providing minimum 12.0 metre frontages for two of the lots, and recognizes the additional two proposed "key-lots" providing comparable lot widths, but reduced lot frontages. It is StaWs understanding that Council recognized, in their revised approval, that the proposed "key-lots" would not provide minimum lot frontages of 12.0 metres at the street frontage. The proposed "key-lots" do, however, provide lot widths in excess of 12.0 metres where dwelling units are proposed to be sited. The enclosed draft implementing zoning by-law encourages dwelling units within a south-east portion of the subject lands to be sited as close as possible to Wildwood Crescent, while protecting existing vegetation within the rear of those proposed lots. To achieve this, a larger-than-normal minimum rear yard depth is required (minimum 17.5 metres), and a 10-metre deep open space zone category has been established within the rear yard of those lots. The enclosed draft implementing zoning by-law incorporates all limitations and restrictions set out and intended by City Council. A proposed Siting and Architectural Design Statement and Functional Servicing Report have been submitted to the City, and subject to requested revisions, are acceptable to the City. The Durham Region Land Division Committee conditionally approved related land severance applications LD 253/01 to LD 256/01 on Monday, December 10, 2001. Conditions of approval to be fulfilled prior to the applicant perfecting these severances include those conditions of approval required by City Council through this zoning by-law amendment application, including the adherence to, and approval of, a Siting and Architectural Design Statement and Functional Servicing Report. Whereas Section 51.2 of the Planning Act, R.S.O. 1990, c. P. 13 as amended, permits the Council of the City of Picketing lthe "Council") to delegate all or any part o£ the authority to approve plm~s of subdivision or condominium description to an appointed officer where the authority to approve plans of subdivisions or condominium description has been delegated to the Council. And Whereas by Bylaw 77-2001 the Regional Municipality o£ Durham has delegated the authority to approve applications tbr plans o1' subdivisions or condominium description to Council. And in order to obtain greater efficiency in the administration of' the approval authority for plans of subdivisions or condominium description it is deemed expedient to delegate certain authorities to the Director, Planning & Development. NOW THEREFORE THE COL:NCIL OF THE CORPORATION OF THE CiTY OF PICKERING HEREBY ENACTS :\S FOLLOWS- 1. The Director, Planning & Development is delegated all of the Council's authority under Section 51 of the Planmng Act. R.S.O. 199U, c. P. 13 as amended. The authority delegated to the Director, Planning & Development under Section 1 of this By-law may be assigned by the Director to one of' the following to cover periods of absence of the Director: Manager, Current Operations or Malmger, Policy. Wayne Arthurs, Mayor Bruce Taylor, Clerk f 48 THE CORPORATION OF THE CITY OF PICKERING BY-LAW NUMBER 5932/01 Being a by-law to delegate the powers of the Head to the City Clerk and the Solicitor for the City under the Municipal Freedom of information and Protection of Privacy Act. WHEREAS pursuant to Section 3(3)(a) of the Municipal Freedom of information and Protection of Privacy Act, R.S.O. 1990, c. M.56, as mnended, (MF1PPA)the Head of the h~stitution is Council; and WHEREAS pursuant to Section 3(1) of the MFIPPA, the powers of the Head may be delegated by by-law; WHEREAS Section 73 of the Municipal Act, R.S.O 1990, c.M. 45, as amended, assigns the duties to keep the books, records and accounts of the Council to the Clerk; and WHEREAS the Solicitor for the City is assigned responsibility to carry out the City's general legal services; NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE CITY OF PICKERING ENACTS AS FOLLOWS: Council hereby delegates to the Clerk the powers and duties of the Head as set out in the MFiPPA, with the exception of Section 41 respecting representations to the Commissioner in response to an Appeal. Council hereby delegates to the Solicitor of the City the powers and duties of the Head as set out in Section 41 of the MFIPPA. WHEREAS the Council of the Corporation of the City of Picketing enacted By-law Number 3665/91 on February 18, 1991 to govern the proceedings of Council, any of its committees, the conduct of its Members, and the calling of meetings; and WHEREAS Council passed By-law Number 5874/01 at its regular meeting of August 7, 2001 to establish a standing committee system; and WHEREAS at a Council/staff meeting held on October 29, 2001, there was a consensus of the Members of Council to merge the Finance Committee and Operations Committee; NOW THEREFORE THE COUNCIL OF THE CORPORATION OF TIqE CITY OF PICKERING HEREBY ENACTS AS FOLLOWS; Section 5 of By-law Number 3665/91 is hereby amended by deleting therefrom the following phrase: 5. There shall be tour Standing Committees to be organized as follows: and substituting therefore the following phrase: 5. There shall be three Standing Committees to be orgamzed as follows: Sections 5(c) and 5(d) are hereby deleted and the following is substituted therefore: 5. (c) Finance and~Aoerations Committee (i) The Finance and Operations Committee shall be comprise of all Members of Council. (ii) The Committee shall meet on the tburth Monday of each month at a time and location to be determined by the members of the Committee. (iii) The Chair of the Committee shall be rotated each meeting amongst the Members of Council, excluding the Mayor, in alphabetical order (iv) The Finance and Operations Committee has the power in enquire into and report to Council on any matter that is within the jurisdiction of the Department, Corporate Services and the Department, Operations and Emergency Services and any other matter referred to it by Council. Section 7 is hereby deleted and the following is substituted therefore: 7. The rules of procedure set out in this By-law shall be observed in meetings of the Standing Committee insofar as they are applicable, provided that, (a) a recorded vote shall not be taken on a question before a Committee; (b) subject to Paragraph 7(c), the rules in respect to the introduction of (c) (d) (e) (f) new business in Council and the hearing of delegations shall apply to Committees unless otherwise decided by the Committee; persons that are present at a Standing Committee meeting to speak to an item on the agenda are not required to register as a delegation. the agendas, minutes and any written notices pertaining to any Standing Committee shall be sent to all Members of Council. a report, setting out the recommendations of the Committee, shall be forwarded to the first regular Council Meeting following the meeting of the Committee. Special Meetings of the Standing Committees, (i) the (ii) May be called by the Mayor on condition that Committee does not meet while Council is meeting. (iii) (iv) (v) May be called by the Mayor when requested to do so by a majority of Members of Council. Written notice of a Special Meeting of a Committee must be given to all Members of Council at least twenty-four hours before the time appointed for such meeting. The written notice to be given under clause (iii) shall indicate the nature of the business to be considered at the Special Meeting and the date, time and place of the Meeting. No business other than that indicated in the written notice shall be considered at the Special Meeting except with the unanimous consent of all Members of Council present and voting at such meeting. 4. Wavne Arthurs, Mayor ~ruce Taylor, Clerk NOTICE OF MOTION DATE: DECEMBER 17, 2001 MOVED BY: SECONDED BY: COUNCILLOR BRENNER COUNCILLOR HOLLAND WHEREAS the Council of the Corporation of the City of Pickering enacted By-laws 5476/99, 5477/99 and 5478/99 to amend the urban area Comprehensive Zoning By-laws 2511, 2520 and 3036, respectively, with the intent to allow various types of commercial vehicles that are deemed appropriate or compatible due to their size to park off-road in urban residential areas; and WHEREAS the effect of these amendments was to allow' tow trucks, that are not considered to be in character with a quiet residential neighbourhood, to park off-road in urban residential areas; and WHEREAS the off-road parking regulations established by the amendments should be re-examined based on feedback over the past two years from residents who have expressed that tow trucks are not appropriate in residential areas; NOW THEREFORE the Council of the Corporation of the City of Pickering hereby directs the Director, Planning & Development to prepare a report on the feasibility of prohibiting tow trucks in urban residential neighbourhoods; and FURTHR THAT the Director, Planning & Development report back to Council no later than March 31, 2002 on this matter.
